【摘要】：為減緩源自煤炭使用的生態(tài)環(huán)境不利影響,我國(guó)正在推動(dòng)煤炭利用方式轉(zhuǎn)變,近些年出臺(tái)了《煤炭清潔高效利用行動(dòng)計(jì)劃(2015—2020年)》《工業(yè)領(lǐng)域煤炭清潔高效利用行動(dòng)計(jì)劃》等一系列法律政策,提升了煤炭清潔高效利用水平。但是由于相關(guān)法律政策存在體系不完善、定價(jià)機(jī)制不健全、正向激勵(lì)不足、相關(guān)規(guī)定存在沖突等問(wèn)題,導(dǎo)致法律政策的引導(dǎo)和規(guī)范作用并未充分發(fā)揮�；谫Y源稟賦,短期內(nèi)我國(guó)將很難改變以煤為主的能源結(jié)構(gòu)。為此,建議通過(guò)健全法律政策體系、推動(dòng)定價(jià)機(jī)制改革、加強(qiáng)財(cái)稅支持、增進(jìn)政策協(xié)調(diào)等途徑,使法律政策更加完善、增強(qiáng)可操作性,進(jìn)一步推動(dòng)煤炭清潔高效利用。
[Abstract]:In order to slow down the adverse effects of the ecological environment derived from coal use, China is promoting the transformation of coal utilization patterns. In recent years, a series of legal policies, such as the Action Plan for Clean and efficient Utilization of Coal (2015-2020) and the Action Plan for Clean and efficient Utilization of Coal in Industrial Field, have been issued, which have improved the level of clean and efficient utilization of coal. However, due to the imperfect system, imperfect pricing mechanism, insufficient positive incentive and conflict of relevant provisions, the guiding and normative role of legal policy has not been brought into full play. Based on resource endowment, it will be difficult for China to change the energy structure based on coal in the short term. Therefore, it is suggested that the legal policy system should be improved, the pricing mechanism reform should be promoted, the fiscal and tax support should be strengthened, and the policy coordination should be enhanced, so as to make the legal policy more perfect, enhance the maneuverability, and further promote the clean and efficient utilization of coal.
