【摘要】：醫(yī)患關(guān)系既是一種受醫(yī)學(xué)法律規(guī)范調(diào)整的醫(yī)患之間的權(quán)利義務(wù)關(guān)系,也是一種受醫(yī)學(xué)倫理規(guī)范調(diào)整的醫(yī)患之間的權(quán)利義務(wù)關(guān)系。對醫(yī)患關(guān)系核心屬性的確定,可以撥開醫(yī)患關(guān)系的層層迷霧去探究醫(yī)患倫理關(guān)系的現(xiàn)實(shí)困境和醫(yī)患倫理關(guān)系法律化的現(xiàn)實(shí),并從醫(yī)事法制建設(shè)角度探究如何從醫(yī)學(xué)的特殊性出發(fā),以倫理道德為基礎(chǔ)構(gòu)建和諧的醫(yī)患關(guān)系。
[Abstract]:Doctor-patient relationship is not only a relationship of rights and obligations between doctors and patients regulated by medical legal norms, but also a relationship of rights and obligations between doctors and patients adjusted by medical ethics norms. The determination of the core attributes of the doctor-patient relationship can remove the fog of the doctor-patient relationship and explore the realistic predicament of the doctor-patient ethical relationship and the legalization of the doctor-patient ethical relationship. From the point of view of medical legal system construction, how to construct a harmonious doctor-patient relationship based on ethics and morality is explored from the point of view of the particularity of medicine.
