【摘要】：環(huán)保組織提起公益訴訟是傳統(tǒng)民事訴訟適格原告理論擴(kuò)張的必然結(jié)果。我國的環(huán)境公益訴訟制度是在公共信托理論、環(huán)境權(quán)理論、代際平衡理論和正當(dāng)程序理論等法學(xué)理論的指導(dǎo)下建立起來的,由環(huán)保組織提起公益訴訟符合法律的公正價(jià)值、效益價(jià)值和秩序價(jià)值的要求。目前,我們應(yīng)進(jìn)一步完善環(huán)保組織提起公益訴訟的制度建設(shè),使其價(jià)值最大化,進(jìn)而實(shí)現(xiàn)與法治社會(huì)價(jià)值的相互統(tǒng)一。
[Abstract]:The public interest litigation brought by environmental protection organization is the inevitable result of the expansion of plaintiff's theory of traditional civil litigation. China's environmental public interest litigation system was established under the guidance of public trust theory, environmental right theory, intergenerational balance theory and due process theory, and the public interest litigation brought by environmental protection organizations conforms to the fair value of the law. The requirement of benefit value and order value. At present, we should further improve the system of environmental protection organizations to bring public interest litigation to maximize its value, so as to achieve mutual unification with the social value of the rule of law.
