【摘要】：法律的生命在于實(shí)施。加強(qiáng)對(duì)行政執(zhí)法行為的監(jiān)督,是確保法律正確實(shí)施的重要途徑,是規(guī)范執(zhí)法權(quán)力運(yùn)行的必要環(huán)節(jié),是維護(hù)相對(duì)人合法權(quán)益、營(yíng)造良好經(jīng)濟(jì)發(fā)展環(huán)境的有力手段。在信息技術(shù)飛速發(fā)展和電子政務(wù)席卷全球的背景下,如何利用現(xiàn)代技術(shù)手段進(jìn)一步加強(qiáng)對(duì)行政執(zhí)法行為的監(jiān)督,提高其嚴(yán)格、規(guī)范、公正、文明程度,克服傳統(tǒng)監(jiān)督存在的漏監(jiān)、虛監(jiān)、弱監(jiān)等弊端,是全面依法治國(guó)新形勢(shì)下進(jìn)一步推動(dòng)行政執(zhí)法監(jiān)督體制機(jī)制改革的內(nèi)在要求,是如期建成法治政府新要求下促進(jìn)行政執(zhí)法監(jiān)督措施創(chuàng)新的重要方法。濟(jì)南市為規(guī)范行政執(zhí)法行為、營(yíng)造良好發(fā)展環(huán)境,2010年開始部署建設(shè)行政執(zhí)法電子監(jiān)察工作。本文以濟(jì)南市行政執(zhí)法電子監(jiān)察工作為研究對(duì)象,以行政執(zhí)法監(jiān)督為視角,綜合運(yùn)用文獻(xiàn)法、訪談法等社會(huì)科學(xué)的分析、研究方法,通過詳細(xì)總結(jié)電子監(jiān)察系統(tǒng)的監(jiān)督內(nèi)容、監(jiān)督制度、作用機(jī)理、推進(jìn)模式、建設(shè)路徑等,歸納出行政執(zhí)法電子監(jiān)察工作推進(jìn)中的共性內(nèi)容,為推進(jìn)其運(yùn)用提供經(jīng)驗(yàn)。同時(shí),在與傳統(tǒng)行政執(zhí)法監(jiān)督方式的對(duì)比中,總結(jié)出電子監(jiān)察監(jiān)督內(nèi)容全、監(jiān)督時(shí)段長(zhǎng)、監(jiān)督效率高、監(jiān)督效果好等方面的比較優(yōu)勢(shì),為規(guī)范權(quán)力運(yùn)行提供新的思路和途徑,為強(qiáng)化執(zhí)法監(jiān)督創(chuàng)建更有效的模式范本。在文章的最后,分析出濟(jì)南市行政執(zhí)法電子監(jiān)察工作中存在的網(wǎng)絡(luò)不統(tǒng)一、覆蓋不全面、應(yīng)用不到位、功能不完善等問題,分析其在觀念、體制、制度、技術(shù)等方面的產(chǎn)生原因,提出了理順工作體制、擴(kuò)充系統(tǒng)容量、加強(qiáng)技術(shù)研發(fā)、完善制度體系、融入統(tǒng)一平臺(tái)的建議和措施。以往對(duì)電子監(jiān)察的研究集中于效能監(jiān)督和廉政監(jiān)督兩個(gè)方面,執(zhí)法監(jiān)督方面進(jìn)行的研究是一個(gè)空白。本文以行政執(zhí)法監(jiān)督為視角對(duì)電子監(jiān)察進(jìn)行研究,彌補(bǔ)以往研究的缺失,拓展研究領(lǐng)域。在分析總結(jié)中,一方面在理論上形成了較為成形的研究結(jié)果,填補(bǔ)了濟(jì)南市行政執(zhí)法電子監(jiān)察工作方面的研究空白,另一方面在實(shí)踐中通過分析問題和提出優(yōu)化建議,為濟(jì)南市行政執(zhí)法電子監(jiān)察工作查缺補(bǔ)漏,為其可持續(xù)發(fā)展提供動(dòng)力。
[Abstract]:The life of the law lies in its enforcement. Strengthening the supervision of administrative law enforcement is an important way to ensure the correct implementation of law, a necessary link to standardize the operation of law enforcement power, and a powerful means to safeguard the legitimate rights and interests of the relative person and to create a good environment for economic development. Under the background of the rapid development of information technology and e-government sweeping the world, how to further strengthen the supervision of administrative law enforcement by means of modern technology and improve its strict, standardized, fair and civilized degree, Overcoming the shortcomings of traditional supervision, such as missed supervision, false prison and weak prison, is the inherent requirement to further promote the reform of the system and mechanism of administrative law enforcement supervision under the new situation of ruling the country according to law in an all-round way. It is an important method to promote the innovation of administrative law enforcement supervision measures under the new requirements of the government under the rule of law. In order to standardize the behavior of administrative law enforcement and create a good development environment, Jinan City began to deploy the construction of electronic supervision of administrative law enforcement in 2010. Taking the electronic supervision of administrative law enforcement in Jinan as the research object, from the perspective of the supervision of administrative law enforcement, this paper comprehensively applies the analysis and research methods of social sciences such as literature method, interview method and so on, and summarizes the supervision contents of the electronic supervision system in detail. Supervision system, action mechanism, promotion mode, construction path, etc., summed up the common content of the electronic supervision work of administrative law enforcement, and provided experience for promoting its application. At the same time, in the comparison with the traditional administrative law enforcement supervision, it summarizes the comparative advantages of electronic supervision and supervision, such as full content, long supervision period, high supervision efficiency, good supervision effect, and so on, which provides a new way of thinking and way for standardizing the operation of power. Create more effective model for strengthening law enforcement supervision. At the end of the article, the author analyzes the problems existing in the electronic supervision of administrative law enforcement in Jinan, such as the network is not unified, the coverage is not comprehensive, the application is not in place, the function is not perfect, and so on, and analyzes its concept, system, and so on. Some suggestions and measures are put forward to rationalize the working system, expand the capacity of the system, strengthen the research and development of technology, perfect the system and integrate into the unified platform. In the past, the research on electronic supervision focused on efficiency supervision and clean government supervision, and the research on law enforcement supervision was a blank. This paper studies the electronic supervision from the perspective of administrative law enforcement supervision to make up for the lack of previous research and expand the research field. In the analysis and summary, on the one hand, a relatively formed research result has been formed in theory, which fills up the research gap in the electronic supervision of administrative law enforcement in Jinan, on the other hand, through the analysis of problems and the suggestion of optimization in practice, For Jinan administrative law enforcement electronic supervision work to fill gaps and provide impetus for its sustainable development.
