【摘要】：網(wǎng)絡(luò)安全信息共享制度具有重大的實踐價值,已成為各國網(wǎng)絡(luò)安全立法的重點議題,但在隱私權(quán)保護、反壟斷、責任承擔和政府權(quán)限等方面也引發(fā)了不少爭議。域外法治框架以美國《網(wǎng)絡(luò)安全信息共享法》為典型代表,界定了應(yīng)共享的網(wǎng)絡(luò)安全信息的類型;規(guī)定了聯(lián)邦政府和非聯(lián)邦主體的網(wǎng)絡(luò)安全信息共享;規(guī)定了私主體隱私、自由等權(quán)利的保護和共享信息的責任豁免;限制了政府對共享信息的后續(xù)利用。在借鑒國外立法經(jīng)驗的基礎(chǔ)上,對我國未來立法提出如下建議:明確網(wǎng)絡(luò)安全信息共享的定位和范圍,不僅限于關(guān)鍵信息基礎(chǔ)設(shè)施保護;規(guī)定網(wǎng)信部門負責領(lǐng)導協(xié)調(diào)信息共享,確立具有軍民融合特色的行政體制機制;規(guī)定強制義務(wù)與責任豁免相結(jié)合,以促進私主體參與信息共享;平衡信息共享與私權(quán)保護的關(guān)系,避免政府濫用共享信息。
[Abstract]:Network security information sharing system is of great practical value and has become a key topic in the legislation of network security in various countries. However, it has caused a lot of controversy in the aspects of privacy protection, anti-monopoly, responsibility assumption and government authority. The framework of extraterritorial rule of law takes the United States Network Security Information sharing Act as a typical representative, defines the types of network security information to be shared, and provides for the sharing of network security information between the federal government and non-federal subjects. It stipulates the protection of privacy, freedom and other rights of private subjects and the exemption from the responsibility of sharing information, which limits the government's subsequent use of shared information. On the basis of drawing lessons from foreign legislative experience, this paper puts forward the following suggestions for future legislation of our country: clarifying the location and scope of network security information sharing, not limited to the protection of key information infrastructure; The network information department should be responsible for coordinating the information sharing, establishing the administrative system mechanism with the characteristics of military and civil integration, providing for the combination of compulsory obligation and responsibility exemption, in order to promote the private subject to participate in the information sharing. Balance the relationship between information sharing and private right protection, avoid the government abusing sharing information.
