【摘要】：重大決策屬于可審查的行政行為、利益選擇的政治行為、限制公民權的自由裁量行為和公平正義取向的公共服務行為。這些行為特征要求重大決策必須改變形式合法性審查、民主性及技術理性審查的傳統(tǒng)路徑,從公正維度、公民權維度和裁量權控制維度進行實質合法性審查。比例原則引入決策追責機制并擴張適用后,能夠通過妥當性原則實現(xiàn)決策手段與目的的相關性,通過必要性原則實現(xiàn)對公民權利的最小侵害,通過狹義比例原則實現(xiàn)成本收益之間的平等,利用目的性原則實現(xiàn)決策目的的正當,從而完成重大決策的實質合法性要求。
[Abstract]:The important decision belongs to the reviewable administrative behavior, the political behavior of the choice of interests, the discretionary behavior of restricting citizenship and the behavior of public service oriented towards fairness and justice. These behavioral characteristics require that major decisions must change the traditional path of formal legitimacy review, democratic and technical rationality review, and examine the substantive legitimacy from the dimensions of justice, citizenship and discretion control. When the principle of proportionality is introduced into the decision-making accountability mechanism and expanded, it can realize the correlation between the means of decision and the purpose through the principle of appropriateness, and the principle of necessity can achieve the minimum infringement on the rights of citizens. Through the principle of narrow sense of proportion to realize the equality between cost and income and to use the principle of purpose to realize the legitimacy of decision making, the essential legitimacy requirement of important decision can be fulfilled.
