【摘要】：我國目前存在國家公物總體制度缺失、農(nóng)村基礎(chǔ)設(shè)施概念模糊、農(nóng)村基礎(chǔ)設(shè)施性質(zhì)不明和權(quán)屬不清等問題,不利于對(duì)農(nóng)村基礎(chǔ)設(shè)施的投資、建設(shè)、管理和利用。農(nóng)村基礎(chǔ)設(shè)施屬于公物的范疇,應(yīng)當(dāng)依據(jù)公物理論對(duì)農(nóng)村基礎(chǔ)設(shè)施的概念和性質(zhì)進(jìn)行重新界定,完善我國農(nóng)村基礎(chǔ)設(shè)施權(quán)屬立法體系,并對(duì)農(nóng)村基礎(chǔ)設(shè)施的占用、使用、收益和處分等權(quán)能作出合理的規(guī)定。
[Abstract]:At present, there are some problems in our country, such as the absence of the overall national public property system, the vague concept of rural infrastructure, the unclear nature of rural infrastructure and the unclear ownership, which is not conducive to the investment, construction, management and utilization of rural infrastructure. Rural infrastructure belongs to the category of public property, so the concept and nature of rural infrastructure should be redefined according to the theory of public property, and the legislative system of ownership of rural infrastructure should be perfected, and the occupation and use of rural infrastructure should be improved. The power of income and disposition makes reasonable provision.
