家庭農(nóng)場發(fā)展的法律促進(jìn)機(jī)制研究

【摘要】:在經(jīng)濟(jì)全球化背景下,我國經(jīng)濟(jì)總量已躍居全球第二。我國經(jīng)濟(jì)的發(fā)展離不開農(nóng)村經(jīng)濟(jì)的支撐。黨的十一屆三中全會以來,我國確立了“家庭承包經(jīng)營為主、統(tǒng)分結(jié)合”的雙層經(jīng)營體制,促進(jìn)了我國農(nóng)業(yè)的發(fā)展。但是隨著我國農(nóng)村經(jīng)濟(jì)的快速發(fā)展,家庭承包責(zé)任制已越來越不適應(yīng)現(xiàn)代農(nóng)業(yè)的發(fā)展需求。近年來,國家相繼出臺了一系列政策法規(guī),把“三農(nóng)”問題連續(xù)多次寫入“中央一號文件”,大力倡導(dǎo)發(fā)展農(nóng)業(yè),逐年加大對農(nóng)業(yè)的扶持力度。黨的十八屆三中全會指出:“城鄉(xiāng)二元結(jié)構(gòu)是制約城鄉(xiāng)發(fā)展一體化的主要障礙……要加快構(gòu)建新型農(nóng)業(yè)經(jīng)營體系!痹趪业拇罅Ψ龀趾凸膭(lì)下,我國出現(xiàn)了專業(yè)合作社、公司+農(nóng)戶等新型農(nóng)業(yè)經(jīng)營方式,家庭農(nóng)場作為一種新型農(nóng)業(yè)經(jīng)營方式應(yīng)運(yùn)而生。 國外對家庭農(nóng)場發(fā)展的法律促進(jìn)方面相當(dāng)重視,表現(xiàn)為其有關(guān)家庭農(nóng)場發(fā)展方面的立法比較充分,比如:美國的《宅地法》、《農(nóng)業(yè)基本法》、《農(nóng)業(yè)調(diào)整法》,法國的《農(nóng)業(yè)指導(dǎo)法》、《農(nóng)業(yè)合作社調(diào)整法》,日本的《農(nóng)地法》、《農(nóng)業(yè)基本法》等。在中國的法治社會環(huán)境下,可以說農(nóng)村經(jīng)濟(jì)就是法治經(jīng)濟(jì)。建國以來,我國相繼出臺了《憲法》、《物權(quán)法》、《土地管理法》、《農(nóng)業(yè)法》等法律法規(guī),它們或多或少對發(fā)展我國農(nóng)業(yè)發(fā)展起到一定的促進(jìn)作用,但我國缺乏專門規(guī)定家庭農(nóng)場發(fā)展的法律法規(guī)。本文的研究對象為家庭農(nóng)場發(fā)展的法律促進(jìn)機(jī)制,筆者立足于國內(nèi)生產(chǎn)實(shí)踐,比較國外家庭農(nóng)場發(fā)展法律促進(jìn)機(jī)制的研究狀況,并合理借鑒國外研究經(jīng)驗(yàn),提出怎樣構(gòu)建促進(jìn)我國家庭農(nóng)場發(fā)展的法律機(jī)制。 除前言和結(jié)語外,本文主要分為四個(gè)部分: 第一部分為家庭農(nóng)場發(fā)展的法律促進(jìn)機(jī)制概述。其中,筆者從家庭農(nóng)場發(fā)展法律促進(jìn)機(jī)制的歷史沿革和現(xiàn)實(shí)意義兩方面加以闡述。該部分分別介紹了家庭農(nóng)場的起源、法律屬性及其法律促進(jìn)機(jī)制的背景,闡明家庭農(nóng)場發(fā)展的法律促進(jìn)機(jī)制有助于推動(dòng)農(nóng)業(yè)規(guī);(jīng)營,有利于發(fā)展我國農(nóng)業(yè)生產(chǎn)力,有助于構(gòu)建新型農(nóng)業(yè)經(jīng)營體系。 第二部分是我國家庭農(nóng)場發(fā)展法律促進(jìn)機(jī)制的現(xiàn)狀和問題。本部分從現(xiàn)有促進(jìn)家庭農(nóng)場發(fā)展的法律法規(guī)、土地財(cái)產(chǎn)權(quán)法律保護(hù)制度和土地流轉(zhuǎn)制度等方面著手,闡述了我國家庭農(nóng)場發(fā)展法律促進(jìn)機(jī)制的現(xiàn)狀,并提出我國家庭農(nóng)場存在的主要問題是:宏觀法律體系不健全、財(cái)政法律制度不健全、稅收法律制度不健全、金融法律制度不健全。 第三部分通過比較美、法、日等國家家庭農(nóng)場發(fā)展的法律促進(jìn)機(jī)制,從而得出對我國家庭農(nóng)場發(fā)展法律促進(jìn)機(jī)制的有益啟示。 第四部分是本文的重點(diǎn)。筆者從財(cái)政支持、稅收支持、金融支持以及土地流轉(zhuǎn)和社會化服務(wù)等法律制度的構(gòu)建入手,提出構(gòu)建我國家庭農(nóng)場發(fā)展法律促進(jìn)機(jī)制的具體途徑。
[Abstract]:Under the background of economic globalization, China's total economic volume has leapt to the second place in the world. The development of our country economy is inseparable from the support of rural economy. Since the third Plenary session of the Eleventh Central Committee of the CPC, China has established a two-tier management system of "household contract management as the main, unified and divided management combined", which has promoted the development of agriculture in our country. However, with the rapid development of rural economy in China, the household contract responsibility system has become more and more unsuitable for the development needs of modern agriculture. In recent years, the state has issued a series of policies and regulations, wrote the "three rural issues" into the "Central Committee No. 1 document" for many times, vigorously advocated the development of agriculture, and increased the support for agriculture year by year. The third Plenary session of the 18th CPC Central Committee pointed out: "the dual structure of urban and rural areas is the main obstacle to the integration of urban and rural development. It is necessary to speed up the construction of a new agricultural management system. " With the support and encouragement of our country, there are some new agricultural management methods, such as specialized cooperatives and company farmers, and family farms as a new type of agricultural management have emerged as the times require. Foreign countries attach great importance to the legal promotion of the development of family farms, which is manifested by their relatively adequate legislation on the development of family farms. For example, the "Homestead Law" of the United States, the "basic Law on Agriculture", the "Agricultural Adjustment Act", France's Agricultural guidance Law, Agricultural Co-operative Adjustment Act, Japan's Agricultural Land Law, Agricultural basic Law, etc. In China's legal society environment, it can be said that the rural economy is the rule of law economy. Since the founding of the people's Republic of China, China has successively promulgated laws and regulations such as the Constitution, the property Law, the Land Management Law, and the Agriculture Law. They have played a certain role in promoting the development of agriculture in China. However, our country lacks laws and regulations that specifically regulate the development of family farms. The research object of this paper is the legal promotion mechanism of family farm development. Based on the domestic production practice, the author compares the research status of the legal promotion mechanism of family farm development abroad, and reasonably draws lessons from foreign research experience. How to set up the legal mechanism to promote the development of family farms in China. In addition to the preface and conclusion, this paper is divided into four parts: the first part is an overview of the legal promotion mechanism of family farm development. The author expounds the historical evolution and practical significance of the legal promotion mechanism of family farm development. This part introduces the origin of family farm, its legal attribute and the background of its legal promotion mechanism, and clarifies that the legal promotion mechanism of family farm development is helpful to promote the large-scale management of agriculture and to develop the agricultural productivity of our country. It helps to build a new agricultural management system. The second part is the current situation and problems of legal promotion mechanism of family farm development in China. This part begins with the existing laws and regulations to promote the development of family farms, the legal protection system of land property rights and the land circulation system, and expounds the current situation of the legal promotion mechanism for the development of family farms in China. The main problems of family farm in our country are that the macro legal system is not perfect, the financial legal system is not perfect, the tax legal system is not perfect, and the financial legal system is not perfect. In the third part, by comparing the legal promotion mechanism of family farm development in America, France, Japan and other countries, the beneficial enlightenment to the legal promotion mechanism of family farm development in China is obtained. The fourth part is the focus of this paper. Starting with the construction of financial support, tax support, financial support, land circulation and socialized services, the author puts forward the specific ways to construct the legal promotion mechanism for the development of family farms in China.
