【摘要】：土地是農(nóng)民最寶貴的資源,土地流轉(zhuǎn)市場(chǎng)的繁榮有力地帶動(dòng)了農(nóng)村的發(fā)展。近年來(lái),隨著城鎮(zhèn)化發(fā)展的不斷加快,農(nóng)村土地流轉(zhuǎn)過(guò)程中表現(xiàn)出的問(wèn)題越來(lái)越突出。土地流轉(zhuǎn)制度的不完善造成土地市場(chǎng)的混亂及耕地流失嚴(yán)重等現(xiàn)象,能否解決這些問(wèn)題已成為農(nóng)村經(jīng)濟(jì)發(fā)展的關(guān)鍵所在。問(wèn)題產(chǎn)生既存在國(guó)家權(quán)力機(jī)關(guān)的不規(guī)范行政行為的外在原因,也包括農(nóng)民權(quán)利缺失的內(nèi)在原因。只有從公權(quán)力制約與農(nóng)民權(quán)利保障兩方面同步進(jìn)行改革,才能從根本上解決土地流轉(zhuǎn)制度與農(nóng)村建設(shè)之間的矛盾。
[Abstract]:Land is the most valuable resource for farmers, and the prosperity of land circulation market has driven the development of rural areas. In recent years, with the rapid development of urbanization, the problems in the process of rural land circulation are becoming more and more prominent. The imperfection of land circulation system leads to the chaos of the land market and the serious loss of cultivated land. Whether or not these problems can be solved has become the key to the development of rural economy. The problem not only exists the external cause of the non-standard administrative behavior of the state power organ, but also includes the inherent reason of the peasants' rights lack. The contradiction between the land transfer system and the rural construction can be fundamentally solved only through the simultaneous reform of public power restriction and the protection of farmers' rights.
