【摘要】：農(nóng)村土地承包經(jīng)營(yíng)權(quán)確權(quán)登記頒證試點(diǎn)正在穩(wěn)步推進(jìn)。土地承包經(jīng)營(yíng)權(quán)確權(quán)登記頒證是建立三權(quán)分置制度的前提,是農(nóng)村土地制度改革的抓手。必須在保持穩(wěn)定、尊重民意的前提下,著力解決好土地承包經(jīng)營(yíng)權(quán)確權(quán)登記頒證面臨的三個(gè)主要問(wèn)題:(1)農(nóng)戶和地方領(lǐng)導(dǎo)對(duì)土地承包經(jīng)營(yíng)權(quán)確權(quán)登記頒證認(rèn)知模糊;(2)政策法規(guī)對(duì)土地承包經(jīng)營(yíng)權(quán)確權(quán)頒證規(guī)定缺位;(3)制度設(shè)計(jì)對(duì)土地承包經(jīng)營(yíng)權(quán)確權(quán)流轉(zhuǎn)缺失個(gè)性。要實(shí)現(xiàn)以土地承包經(jīng)營(yíng)權(quán)為主體的農(nóng)村集體土地確權(quán)登記頒證法治化,就必須修改完善農(nóng)村土地管理的法律法規(guī),修改完善土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的法律法規(guī),修改完善土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)登記制度,修改完善農(nóng)民使用土地的勘查和權(quán)屬確認(rèn)辦法。
[Abstract]:Rural land contractual management right to confirm the registration of certification pilot is steadily advancing. The registration and issuance of the confirmed right of land contract management is the premise of the establishment of the system of separation of the three rights and the grasp of the reform of the rural land system. Under the premise of maintaining stability and respecting public opinion, To solve the three main problems in the registration and issuance of the right of land contract management: (1) the cognition of the farmers and local leaders on the registration and issuance of the right to confirm the right to land contract management is vague; (2) the certificate of the right to confirm the right of land contract management is issued by policies and regulations. (3) the system design lacks the individuality to confirm the right of land contract management. In order to realize the legalization of the registration and certification of the rural collective land ownership with the land contract management right as the main body, the laws and regulations governing the improvement of rural land management and the laws and regulations governing the circulation of the land contractual management right must be revised and improved. To revise and improve the registration system for the circulation of the right to land contracting and management, and to revise and perfect the measures for the exploration and ownership of the land used by farmers.
