【摘要】：隨著"好人法"的出臺(tái),有必要從法理角度進(jìn)一步研究法律保衛(wèi)良知的原理和方式。"良知"來自人性之善端,但人性逐利之傾向和計(jì)算理性的存在,也使良知進(jìn)入了成本和效益的計(jì)算之中。當(dāng)良知被主體視為利益實(shí)現(xiàn)的巨大成本時(shí),良知便出現(xiàn)沉淪。于是,良知的呈現(xiàn)便面臨內(nèi)在和外在的壓力,內(nèi)在壓力為自我利益的計(jì)較,外在壓力為外界環(huán)境的逼迫。法律能夠保衛(wèi)良知是因?yàn)榉烧{(diào)整利益關(guān)系,能夠減少良知實(shí)現(xiàn)的成本負(fù)擔(dān)。法律對(duì)良知的保衛(wèi)要求法律充當(dāng)良知抵御壓力的屏障,減少良知行為的成本支出。具體而言,法律通過防范壓善行為、懲治欺善行為以及通過自身揚(yáng)善行為等方式來保衛(wèi)良知。
[Abstract]:With the introduction of the Law of good people, it is necessary to further study the principle and method of legal defense of conscience from the angle of legal theory. " Conscience "comes from the good end of human nature, but the tendency of human nature to pursue profit and the existence of computational reason also make conscience enter into the calculation of cost and benefit." When conscience is regarded as the huge cost of interest realization by the subject, conscience will sink. Therefore, the presentation of conscience will face internal and external pressure, internal pressure for self-interest, external pressure for the external environment. The law can defend conscience because it adjusts the interest relation and reduces the cost burden of conscience realization. The protection of conscience by law requires law to act as a barrier against pressure and to reduce the cost of conscience. Specifically, the law protects conscience by preventing acts of oppression, punishing good practices and promoting good deeds.
