【摘要】：在我國憲法框架內(nèi),"計劃生育"是作為生育權限制的制度形式,其對于人口的調(diào)控應適應經(jīng)濟發(fā)展與社會發(fā)展計劃的需要。"計劃生育"重構于比較法學中的"生育控制"理念,生育權的自由屬性與社會經(jīng)濟發(fā)展的適度匹配,闡釋了生育控制的必要性與所應保有的制度底線。中國計劃生育制度的實踐表明,其調(diào)控方式經(jīng)歷純粹的政策主導,再到形式法治的治理,最終邁進實質(zhì)法治范疇。而要徹底實現(xiàn)實質(zhì)的法治,必須對"計劃"作出清晰的內(nèi)涵判斷,以實現(xiàn)政策工具和法律機制的無縫銜接。藉由計劃生育制度憲法條款的全面實施來完成計劃生育制度的轉(zhuǎn)型:即由人口調(diào)控的經(jīng)濟主義單軌制轉(zhuǎn)型至兼顧社會發(fā)展中社會主體權利實現(xiàn)的雙軌制,才是未來計劃生育制度調(diào)整的憲法正道。
[Abstract]:Within the framework of our country's constitution, "family planning" is a system form of restriction of reproductive right, and its regulation and control of population should meet the needs of economic development and social development plan. " Family planning "reconstructs the concept of" birth control "in comparative law, the free attribute of reproductive right and the appropriate match of social and economic development, explains the necessity of birth control and the system bottom line that should be maintained. The practice of China's family planning system shows that its regulation and control mode has experienced pure policy leading, then the governance of formal rule of law, and finally stride into the category of substantive rule of law. In order to realize the essential rule of law thoroughly, we must make a clear judgment on the connotation of the "plan" so as to realize the seamless connection between the policy tools and the legal mechanism. Through the full implementation of the constitutional provisions of the family planning system, the transition of the family planning system is completed: from the economicism of population control to the realization of the rights of social subjects in the course of social development. Is the future family planning system adjustment of the constitutional path.
