【摘要】：隨著我國(guó)經(jīng)濟(jì)社會(huì)的高速發(fā)展,人員和物資的流動(dòng)空前頻繁,全社會(huì)的汽車(chē)保有量和駕駛?cè)藬?shù)量快速增長(zhǎng),而道路通車(chē)?yán)锍痰脑鲩L(zhǎng)速度卻相對(duì)緩慢,道路交安全設(shè)施的建設(shè)也相對(duì)滯后,造成人、車(chē)、路、環(huán)境之間的矛盾凸顯,由此引發(fā)的道路交通事故數(shù)量也急劇增長(zhǎng)。道路交通事故的發(fā)生嚴(yán)重地威脅著人們的生命財(cái)產(chǎn)安全,據(jù)不完全統(tǒng)計(jì),近年來(lái)我國(guó)平均每年發(fā)生道路交通事故15萬(wàn)余起,造成人員受傷15萬(wàn)余人,造成人員死亡7萬(wàn)余人,造成財(cái)產(chǎn)損失近10億元人民幣。道路交通事故發(fā)生后,每一個(gè)當(dāng)事人及其家屬無(wú)不希望能得到公正的處理,能得到合理的事故損害賠償。公安機(jī)關(guān)交通管理部門(mén)是處理道路交通事故的法定主體。在道路交通事故處理工作中,道路交通事故認(rèn)定是最重要的環(huán)節(jié)。道路交通事故認(rèn)定是一項(xiàng)法律性和專(zhuān)業(yè)性很強(qiáng)的工作,是公安機(jī)關(guān)交通管理部門(mén)對(duì)交通事故的基本事實(shí)、產(chǎn)生原因和當(dāng)事人的行為過(guò)錯(cuò)及應(yīng)承擔(dān)的事故責(zé)任等作出的具體分析和認(rèn)定�！兜缆方煌ò踩ā芳捌渑涮追ㄒ�(guī)規(guī)定,公安機(jī)關(guān)交通管理部門(mén)應(yīng)當(dāng)根據(jù)道路交通事故當(dāng)事人的違法行為對(duì)發(fā)生交通事故所起的作用以及該行為的過(guò)錯(cuò)嚴(yán)重程度,確定道路交通事故當(dāng)事人的責(zé)任。由此可知,公安機(jī)關(guān)交通管理部門(mén)認(rèn)定道路交通事故,一要依法確認(rèn)道路交通事故中各方當(dāng)事人應(yīng)履行的法定義務(wù)以及何方當(dāng)事人應(yīng)當(dāng)優(yōu)先履行法定義務(wù),二要查找各方當(dāng)事人實(shí)施的引發(fā)道路交通事故的違法行為并確認(rèn)該行為在道路交通事故中的作用大小,最后劃分各方當(dāng)事應(yīng)承擔(dān)的道路交通事故責(zé)任。道路交通事故認(rèn)定實(shí)際上是公安交通管理部門(mén)對(duì)道路交通事故的成因分析,是對(duì)造成道路交通事故原因的確認(rèn)。公安機(jī)關(guān)交通管理部門(mén)制作的道路交通事故認(rèn)定書(shū)是當(dāng)事人是否承擔(dān)民事責(zé)任、行政責(zé)任、刑事責(zé)任的法律依據(jù)。我們要避免將公安交通管理部門(mén)的道路交通事故認(rèn)定,簡(jiǎn)單等同于當(dāng)事人民事責(zé)任的確定,應(yīng)將這一認(rèn)定作為劃分當(dāng)事人事故責(zé)任的重要證據(jù)材料。在道路交通事故處理工作實(shí)踐中,由于未厘清道路交通事故基本概念、未區(qū)分道路交通事故責(zé)任與民事?lián)p害賠償責(zé)任等原因造成交通事故認(rèn)定困難。道路交通事故認(rèn)定是一項(xiàng)既有法治思維又有實(shí)戰(zhàn)技能的工作,法律性嚴(yán)、權(quán)威性強(qiáng)、專(zhuān)業(yè)性高、群眾性廣,面對(duì)新形勢(shì)新情況新問(wèn)題,我們要用法治思維、法治方式去統(tǒng)領(lǐng)這項(xiàng)工作,要用學(xué)習(xí)提高的態(tài)度、務(wù)實(shí)有效的辦法去開(kāi)展這項(xiàng)工作。本文中,筆者進(jìn)一步強(qiáng)調(diào)了研究道路交通事故認(rèn)定的現(xiàn)實(shí)意義,從道路交通事故的基本概念、基本理論入手,以實(shí)證分析法為基礎(chǔ),對(duì)現(xiàn)行法律制度框架下道路交通事故認(rèn)定工作所存在的問(wèn)題進(jìn)行了深入分析,并針對(duì)當(dāng)事人對(duì)道路事故認(rèn)定不服的救濟(jì)方式不足、交通事故認(rèn)定規(guī)則不足、道路交通事故認(rèn)定中的困惑、道路交通事故認(rèn)定的監(jiān)督和制約及救濟(jì)途經(jīng)存在弊端、事故處理民警的能力素質(zhì)亟待提高等方面的問(wèn)題提出完善道路交通事故認(rèn)定的措施。
[Abstract]:With the rapid development of our country's economy and society, the flow of personnel and materials is unprecedentedly frequent, the quantity of car ownership and the number of drivers in the whole society are increasing rapidly, but the growth rate of road traffic mileage is relatively slow, and the construction of road safety facilities is lagging behind. The contradiction between people, cars, roads and environment is highlighted. The number of road traffic accidents has also increased rapidly. The occurrence of road traffic accidents seriously threatens the safety of people's life and property. According to incomplete statistics, in recent years, more than 15 million road traffic accidents have occurred in China, causing more than 15 people to be injured, resulting in more than 7 deaths, resulting in the property loss of nearly 1 billion yuan. After the accident, every party and his family are hoping to get a fair treatment and get a reasonable compensation for the accident damage. The traffic management department of the public security organ is the legal subject to deal with the road traffic accidents.
