【摘要】：國家責任是國家歷經(jīng)不同階段逐漸演進而形成的制度。公私合作執(zhí)行行政任務中,國家任務履行主體和履行方式的變遷促使國家責任形式發(fā)生轉(zhuǎn)變。公私合作執(zhí)行行政任務中,國家責任分兩種類型:涉及公權(quán)力行使的和不涉及公權(quán)力行使的。涉及公權(quán)力行使的國家責任包括兩種情況:其一,私人屬于授權(quán)行使公權(quán)力的,私人承擔國家責任;其二,私人屬于委托行使公權(quán)力的,由行政機關承擔國家責任。不涉及公權(quán)力行使的國家責任,國家責任表現(xiàn)為行政機關負擔保責任。
[Abstract]:State responsibility is a system formed by the gradual evolution of the state through different stages. In the administrative task of public-private cooperation, the change of the main body and mode of state task makes the form of state responsibility change. In public-private cooperation, there are two types of state responsibility: those involving the exercise of public power and those not involving the exercise of public power. The state responsibility involving the exercise of public power includes two situations: one is that the private person is authorized to exercise the public power, the private person bears the state responsibility; the other is that the private person is entrusted with the exercise of the public power, the administrative organ shall bear the state responsibility. State responsibility, which does not involve the exercise of public power, is the responsibility of the administrative organ.
