國家教育考試中公民受教育權(quán)保障探究

【摘要】:受教育權(quán)是公民享有的一項(xiàng)基本權(quán)利,可謂是學(xué)界研究的熱點(diǎn)。近年來對受教育權(quán)研究從最初的權(quán)利性質(zhì)、權(quán)利救濟(jì)等宏觀視角的研究,再到現(xiàn)在對留守兒童的受教育權(quán)、弱勢群體的受教育權(quán)、罪犯的受教育權(quán)等微觀視角的研究,然而對國家教育考試中的公民受教育權(quán)的研究屈指可數(shù)。就我國現(xiàn)有的教育體制而言,國家教育考試卻是與公民享有受教育權(quán)緊密相連的一個環(huán)節(jié),研究和探析國家教育考試中的公民受教育權(quán)一方面可以為受教育權(quán)的研究提供一個嶄新的視角,盡自己所能為受教育權(quán)的理論研究添磚加瓦;另外一方面還可以使得公民深刻認(rèn)識、深入了解在國家教育考試中所享有的權(quán)利,進(jìn)而更好地保障公民的受教育權(quán)。 就本文結(jié)構(gòu)而言,全文總共分為五個部分。第一部分首先從基礎(chǔ)理論入手,深入探討國家教育考試中公民受教育權(quán)的顯要特征,為后文的論述做好理論上的鋪墊;第二部分從公民自身發(fā)展、社會秩序穩(wěn)定以及國家教育考試制度運(yùn)行三方面來論證保障國家教育考試中公民受教育權(quán)的必要性,為本文的研究尋求理論依據(jù);第三部分則是以高等學(xué)校招生考試、研究生招生考試在運(yùn)行中出現(xiàn)的典型事例為切入點(diǎn)具體分析在國家教育考試的命題階段、施測階段和評卷階段中保障公民受教育權(quán)所面臨的一系列困境,為公民在國家教育考試中的受教育權(quán)保障提供現(xiàn)實(shí)依據(jù);第四部分則是從規(guī)范層面、考試機(jī)構(gòu)設(shè)置層面、考試權(quán)運(yùn)行層面以及公民權(quán)利意識層面來深入分析保障公民在國家教育考試中受教育權(quán)所面臨困境的原因,進(jìn)而能夠明白面臨困境的癥結(jié)所在;第五部分承接著第四部分的成因分析,,筆者試著提出與之相對應(yīng)的保障公民在國家教育考試中受教育權(quán)的實(shí)現(xiàn)路徑。
[Abstract]:The right to education is a basic right enjoyed by citizens. In recent years, the research on the right to education has changed from the macroscopic perspective of the nature of the right to education, the relief of the right to education, and so on, to the study of the right to education of left-behind children, the right to education of the disadvantaged groups, the right to education of criminals, and so on. However, there are only a few studies on the right of citizens to receive education in the national educational examination. As far as China's existing education system is concerned, the national education examination is a link closely linked to the right of citizens to receive education. On the one hand, it can provide a new angle of view for the study of the right to education, and do its best to contribute to the theoretical study of the right to education; On the other hand, it can make the citizens deeply understand and understand the rights in the national education examination, and then better protect the citizens' right to receive education. As far as the structure of this paper is concerned, the paper is divided into five parts. The first part starts with the basic theory, deeply discusses the prominent characteristics of the citizen's right to receive education in the national education examination, and lays a good theoretical foundation for the later discussion; the second part is the citizen's own development. Social order stability and the operation of the national education examination system to demonstrate the necessity of ensuring the citizens' right to education in the national education examination, and to seek theoretical basis for the study of this paper. The typical examples in the operation of graduate enrollment examination are as follows: the starting point is the analysis of a series of dilemmas in the propositional stage of the national educational examination, the stage of testing and the stage of grading the citizen's right to receive education. The fourth part is to provide a realistic basis for the protection of citizens' right to receive education in the national education examination; the fourth part is from the normative level, the examination organization set up the level, The operating level of examination right and the level of citizen's right consciousness to deeply analyze the reasons for the dilemma of protecting citizens' right to receive education in the national education examination, and then to understand the crux of the dilemma; The fifth part carries on the cause analysis of the fourth part, the author tries to put forward the corresponding path to ensure citizens' right to receive education in the national education examination.
