行政法視域下個人信息的保護研究

【摘要】:近些年來,隨著我國市場經(jīng)濟、社會的發(fā)展、公民覺悟意識的提高,社會公眾的需求“倒逼”政府及相關(guān)部門更加關(guān)注個人信息保護的問題,個人信息的行政法保護有所進展。但是,我國個人信息行政法保護的形勢仍然不容樂觀。以目前的情形來看,我國對個人信息的行政法保護主要是通過某些政府部門規(guī)章的形式進行調(diào)整的,這些部門規(guī)章規(guī)定立法層級較低,無法適應(yīng)當前個人信息屢屢遭受侵害的現(xiàn)實需要。因為缺乏相應(yīng)的統(tǒng)一法律,所以導致個人信息在行政法領(lǐng)域的保護范圍難以進行界定。個人信息保護中存在的顯著弊病是,公共部門對個人信息的收集缺乏規(guī)范。公共權(quán)力機構(gòu)由于其掌握了大量的公權(quán)力,導致其在行政活動或者其他公共活動中為了維護社會公共利益,甚至為了達到一己之私利而違法收集和使用公民個人信息。某些行政機關(guān)為了在行政活動中“維護”自身的利益而收集和使用大量的公民個人信息,導致對公民的個人信息相關(guān)權(quán)益造成巨大的損害。與此同時,按照我國現(xiàn)行相關(guān)規(guī)定,非國家機關(guān)介入到公民個人信息等侵權(quán)行為也時有發(fā)生,在這方面的規(guī)定也大多數(shù)具有防御性、消極性,無法體現(xiàn)更高的效益。尤其是,,個人信息一旦被侵犯,其缺乏必要的救濟途徑,這是法律的缺陷與空白所導致的,亟待加以改進。和世界上其他發(fā)達國家的個人信息行政法保護的情況相較而言,我國的個人信息行政法保護還處于一個較低層次的水平,我國公民個人信息保護的法律法規(guī)還不夠健全、不夠完善。 針對當前我國公民個人信息行政法保護中存在的缺陷與問題,本文提出了行政法視域下我國公民個人信息保護的對策路徑:一是針對當前個人信息保護的法律較為分散的實際,制定出臺《個人信息保護法》;二是針對目前對相關(guān)機構(gòu)收集個人信息的程序不規(guī)范的實際,應(yīng)對收集與利用個人信息進行嚴格的程序規(guī)制;三是針對當前監(jiān)督管理缺位的現(xiàn)狀,完善公民個人信息利用的監(jiān)督管理法律體系;四是針對目前公民個人信息權(quán)遭受侵害而無法尋求救濟的實際,健全完善救濟制度。
[Abstract]:In recent years, with the development of the market economy, the development of the society and the improvement of the consciousness of the citizens, the demand of the public has pushed the government and the relevant departments to pay more attention to the protection of personal information, and the administrative law protection of personal information has made some progress. However, the situation of protection of personal information administrative law is still not optimistic. In the current situation, the administrative law protection of personal information in our country is mainly regulated by the regulations of certain government departments, which stipulate that the level of legislation is relatively low. Can not adapt to the current personal information repeatedly suffered violations of the reality of the needs. Due to the lack of uniform laws, it is difficult to define the scope of protection of personal information in the field of administrative law. The obvious drawback of personal information protection is the lack of standardization in the collection of personal information in the public sector. Because the public authority has a large amount of public power, it collects and uses citizens' personal information illegally in administrative activities or other public activities in order to safeguard the public interests, and even to achieve their own private interests. In order to "safeguard" their own interests in administrative activities, some administrative organs collect and use a large amount of personal information of citizens, which results in great damage to citizens' rights and interests related to personal information. At the same time, according to the current relevant provisions of our country, non-state organs intervene in the civil personal information and other tort acts also occur from time to time. Most of the provisions in this respect are defensive, negative, unable to reflect higher benefits. Especially, once personal information is infringed, it lacks the necessary remedy, which is caused by the defect and blank of law, and needs to be improved urgently. Compared with the protection of personal information administrative law in other developed countries in the world, the protection of personal information administrative law in our country is still at a lower level, and the laws and regulations of personal information protection of Chinese citizens are not perfect enough. Not perfect enough. In view of the defects and problems existing in the protection of citizen's personal information in administrative law, this paper puts forward the countermeasures for the protection of personal information in China from the perspective of administrative law: firstly, it aims at the scattered law of the protection of personal information. To formulate and issue the personal Information Protection Law; second, to strictly regulate the collection and utilization of personal information in view of the fact that the procedures for collecting personal information by relevant institutions are not standardized; and third, to address the current situation of the absence of supervision and management. The fourth is to perfect the relief system in view of the fact that the citizen's personal information right has been infringed and cannot seek remedy.
