【摘要】:我國(guó)正在從農(nóng)業(yè)國(guó)向工業(yè)國(guó)轉(zhuǎn)變的道路上大步邁進(jìn),城鎮(zhèn)化的程度也在不斷提升,農(nóng)業(yè)的發(fā)展需要擺脫零碎化經(jīng)營(yíng)模式,進(jìn)行集中規(guī)模化生產(chǎn)。在當(dāng)前的形勢(shì)下,農(nóng)村承包土地經(jīng)營(yíng)權(quán)(以下簡(jiǎn)稱(chēng)農(nóng)地經(jīng)營(yíng)權(quán))抵押順應(yīng)了我國(guó)城鎮(zhèn)化的趨勢(shì),符合走農(nóng)業(yè)現(xiàn)代化發(fā)展道路的需求。十八屆三中全會(huì)以來(lái),政策允許土地承包經(jīng)營(yíng)權(quán)以抵押方式進(jìn)行流轉(zhuǎn)。中央辦公廳、國(guó)務(wù)院辦公廳聯(lián)合出臺(tái)意見(jiàn),該意見(jiàn)肯定了三權(quán)分置的學(xué)說(shuō)理論,將經(jīng)營(yíng)權(quán)從土地承包經(jīng)營(yíng)權(quán)中獨(dú)立出來(lái),堅(jiān)持農(nóng)村土地集體所有以保證我國(guó)的公有制性質(zhì);不變農(nóng)戶(hù)承包土地確保土地改革的穩(wěn)妥推進(jìn);放活土地實(shí)際經(jīng)營(yíng)以激發(fā)市場(chǎng)需求。意見(jiàn)同時(shí)提出應(yīng)該盡快修改相關(guān)法律保證改革有法可依,做好確權(quán)登記工作打好土地改革的基礎(chǔ),建立相應(yīng)配套機(jī)制確保經(jīng)營(yíng)權(quán)流轉(zhuǎn)規(guī)范有序。雖然黨和國(guó)家的政策已經(jīng)允許和鼓勵(lì)包括以經(jīng)營(yíng)權(quán)抵押方式在內(nèi)的土地流轉(zhuǎn),國(guó)家的法律層面目前依然沒(méi)有改變,禁止性條款依然生效,農(nóng)地經(jīng)營(yíng)權(quán)抵押的緊箍咒并未消失。受法律、政策及司法解釋等相關(guān)規(guī)范性文件相互沖突的影響,法院在司法實(shí)踐中如何處理農(nóng)地經(jīng)營(yíng)權(quán)抵押意見(jiàn)不一,禁止、回避、默許及鼓勵(lì)的態(tài)度致使判決結(jié)果紛繁復(fù)雜,這不利于人民群眾對(duì)農(nóng)地經(jīng)營(yíng)權(quán)抵押獲得合理預(yù)期,不利于人民群眾得到正確的規(guī)范性指引。在黨和國(guó)家政策的鼓勵(lì)下,實(shí)踐中已有不少試點(diǎn)地區(qū)先行一步,農(nóng)地經(jīng)營(yíng)權(quán)抵押突飛猛進(jìn)的快速發(fā)展的同時(shí)也遇到了不少的問(wèn)題。這些問(wèn)題包括農(nóng)村土地確權(quán)登記工作面臨重重困難,農(nóng)地經(jīng)營(yíng)權(quán)價(jià)值評(píng)估工作缺乏獨(dú)立的機(jī)構(gòu)和專(zhuān)業(yè)的人員,抵押平臺(tái)并沒(méi)有在大范圍內(nèi)建立,相關(guān)保障機(jī)制并沒(méi)有得到建立和健全。推行農(nóng)地經(jīng)營(yíng)權(quán)抵押,農(nóng)村綜合產(chǎn)權(quán)交易所的模式值得推廣,農(nóng)業(yè)保險(xiǎn)制度對(duì)于減少抵押人經(jīng)營(yíng)農(nóng)業(yè)時(shí)遇到的風(fēng)險(xiǎn)意義重大。同時(shí)必須建立農(nóng)民的保障體系,建立最低生活保障機(jī)制消除農(nóng)民基本生活焦慮,建立農(nóng)民失業(yè)保險(xiǎn)穩(wěn)定農(nóng)民失地失業(yè)的不安、建立醫(yī)療保險(xiǎn)機(jī)制解決農(nóng)民患病就醫(yī)的困難,建立農(nóng)民養(yǎng)老保險(xiǎn)消除農(nóng)民養(yǎng)老的憂慮。
[Abstract]:China is making great strides from the agricultural country to the industrial country, and the degree of urbanization is also increasing. The development of agriculture needs to get rid of the piecemeal mode of management and carry out concentrated and large-scale production. Under the current situation, the rural contracted land management right (hereinafter referred to as the farmland management right) mortgage conforms to the trend of urbanization in China and meets the needs of the development of agricultural modernization. Since the third Plenary session of the 18th CPC Central Committee, the policy allows the transfer of land contractual management rights by way of mortgage. The General Office of the Central Committee and the General Office of the State Council jointly issued the opinion, which affirmed the theory of the separation of the three rights, independent the management right from the land contract management right, and insisted on the collective ownership of rural land in order to ensure the public ownership nature of our country; The unchanging peasant household contracts the land to ensure the land reform to advance steadily, to release the land actual management in order to stimulate the market demand. At the same time, it is suggested that the relevant laws should be amended as soon as possible to ensure that there are laws to be followed, that the registration of confirmed rights should be done well on the basis of land reform, and that a corresponding supporting mechanism should be established to ensure that the circulation of management rights is orderly and orderly. Although the policies of the Party and the state have allowed and encouraged the transfer of land, including the form of mortgage of management rights, the legal aspect of the country has not changed, the prohibition clause is still in force, and the magic of the mortgage of the right to manage agricultural land has not disappeared. Influenced by the conflict of relevant normative documents, such as law, policy and judicial interpretation, the court has different opinions on how to deal with the mortgage of farmland management right in judicial practice. The attitude of prohibition, avoidance, acquiescence and encouragement makes the judgment result complicated and complicated. This is not conducive to the people to obtain reasonable expectations of the right to manage farmland mortgage, is not conducive to the people to get the correct normative guidance. Under the encouragement of the Party and the state policy, many pilot areas have already taken the lead in practice, and the rapid development of the land management right mortgage has also met with many problems at the same time. These include difficulties in the registration of rural land tenure, lack of independent institutions and professionals in the evaluation of the value of agricultural land management rights, and lack of extensive establishment of mortgage platforms. Relevant safeguard mechanism has not been established and perfect. The mode of rural comprehensive property exchange is worth popularizing to carry out the mortgage of agricultural land management right, and the agricultural insurance system is of great significance to reduce the risks encountered by mortgagors in managing agriculture. At the same time, it is necessary to set up a guarantee system for farmers, establish a minimum living security mechanism to eliminate the peasants' basic life anxiety, establish a farmer unemployment insurance to stabilize the peasants' unease of losing their land, and establish a medical insurance mechanism to solve the difficulties for farmers to get sick and seek medical treatment. The establishment of farmers pension insurance to eliminate the worries of farmers to provide for the aged.
