試論食品安全可追溯制度

【摘要】:隨著經(jīng)濟(jì)的發(fā)展和人民生活水平的提高,人們對食品安全和質(zhì)量的要求越來越高。而近些年,,在人們賴以生存的食品行業(yè),三聚氰胺奶粉事件、蘇丹紅事件、含鎘毒大米等食品安全事件頻頻爆發(fā),挑戰(zhàn)著消費者對食品安全的信任和信心,也使得食品安全監(jiān)管問題備受關(guān)注。 為重塑消費者對食品安全的信心,我國2009年出臺《食品安全法》試圖建立從農(nóng)田到餐桌的全程監(jiān)管,但是收效甚微。近幾年隨著食品安全監(jiān)管經(jīng)驗的積累,監(jiān)管機(jī)構(gòu)認(rèn)識到,要從源頭控制食品安全問題,建立食品安全事前防控機(jī)制,引進(jìn)國外食品安全可追溯體系。目前,我國食品安全可追溯制度的構(gòu)建已經(jīng)取得一定成效,但在立法方面仍然存在著一系列問題。 本文通過對比介紹中美食品安全可追溯制度,分析美國食品安全可追溯制度監(jiān)管格局和立法體系對于中國的啟示,為建立完善的食品安全可追溯制度提出立法建議。 第一部分,緒論。對本文的研究對象所處背景和意義做詳細(xì)介紹,提出本文研究的目標(biāo)、研究的思路和研究的內(nèi)容,以及對本文所涉及的相關(guān)概念進(jìn)行了明確。第二部分,食品安全可追溯制度概述。對食品安全可追溯制度的理論根源、基本原理、類型和基本功能進(jìn)行系統(tǒng)介紹。第三部分,美國食品安全可追溯制度。從監(jiān)管格局和立法兩方面來介紹美國食品安全可追溯制度,并得出對中國的啟示和可借鑒之處。第四部分,中國食品安全可追溯制度。第一節(jié)介紹2013年大部制改革,并分析改革對建立食品安全可追溯制度所作出的鋪墊工作;第二節(jié)介紹中國目前形成的食品安全可追溯制度立法現(xiàn)狀,并分析其不足與缺陷。第五部分,通過對比分析中美兩國的食品安全可追溯制度建設(shè)情況,在借鑒美國經(jīng)驗的基礎(chǔ)上,提出完善食品安全可追溯制度的立法建議。第六部分,得出結(jié)論。
[Abstract]:With the development of the economy and the improvement of the people's living standards, the demand for food safety and quality is becoming more and more high. In recent years, in the food industry that people rely on, the incidents of melamine milk powder, Sudan red, and cadmium containing rice frequently erupt, challenging consumers' trust and confidence in food safety. The issue of food safety regulation has attracted much attention.
In order to reshape the consumer's confidence in food safety, China introduced the food safety law in 2009, trying to establish the whole course supervision from the farmland to the table, but with little effect. In recent years, with the accumulation of food safety supervision experience, the regulators realized that the problem of food safety should be controlled from the source, and the pre control mechanism of food safety should be established and the importing country should be established. At present, some achievements have been made in the construction of the traceability system for food safety in China, but there are still a series of problems in the legislation.
Through the comparison and introduction of the traceability system of food safety in China and the United States, this paper analyzes the revelation of the regulatory framework and legislative system of the traceability system of food safety in the United States, and puts forward legislative proposals for the establishment of a perfect traceability system for food safety.
The first part is introduction. It introduces the background and significance of the research object in detail, puts forward the objectives of the study, the ideas and contents of the research, and makes clear the related concepts involved in this article. The second part, the overview of the traceability system of food safety. The theoretical roots of the traceability system for food safety are basic. The third part, the United States food safety traceability system, introduced the traceability system of American food safety from two aspects of supervision pattern and legislation, and drew the inspiration and reference of China. The fourth part, the traceability system of food safety in China. The first section introduces the 2013 major system reform. The second section introduces the present status of the legislation of the food safety traceability system in China, and analyzes its shortcomings and shortcomings. The fifth part, through a comparative analysis of the construction of the traceability system of food safety in both China and the United States, is a reference to the basis of American experience. On the basis of this, we put forward the legislative proposals to improve the traceability system of food safety. The sixth part draws the conclusion.
