【摘要】：近年來,我國煤礦安全生產(chǎn)水平的提升遇到了瓶頸,和美國、澳大利亞、南非、印度等世界主要產(chǎn)煤國家相比還存在較大差距。與此同時,我國煤礦安全監(jiān)管部門監(jiān)管水平的提升也遇到了瓶頸。存在這些問題的重要原因是我國煤礦安全監(jiān)管部門的法定職責(zé)設(shè)置存在種種問題:中央和地方政府以及煤礦安全監(jiān)管部門之間的法定職責(zé)劃分不明確不合理;煤礦安全監(jiān)管部門法定職責(zé)設(shè)置造成煤礦安全監(jiān)管部門超能力監(jiān)管;煤礦安全監(jiān)管部門法定職責(zé)中缺少對部分領(lǐng)域的監(jiān)管職責(zé)。歸納總結(jié)出煤礦安全監(jiān)管部門法定職責(zé)設(shè)置存在的問題,并分析這些問題存在的直接原因和根本原因。進(jìn)一步提出重構(gòu)我國煤礦安全監(jiān)管部門法定職責(zé)的設(shè)想:構(gòu)建統(tǒng)一的煤礦安全監(jiān)管法律體系;合理明晰界定中央和地方政府以及煤礦安全監(jiān)管部門之間的煤礦安全監(jiān)管法定職責(zé);合理界定煤礦安全監(jiān)管部門的的強制監(jiān)管職責(zé);增加煤礦安全監(jiān)管部門對煤礦安全培訓(xùn)市場、煤礦安全技術(shù)服務(wù)市場的引導(dǎo)和規(guī)制職責(zé);增加煤礦安全監(jiān)管部門對煤炭相關(guān)行業(yè)協(xié)會的扶持和引導(dǎo)職責(zé)。通過重構(gòu)我國煤礦安全監(jiān)管部門的法定職責(zé),提升煤礦安全監(jiān)管部門的監(jiān)管水平,提升我國的煤礦安全生產(chǎn)水平。
[Abstract]:In recent years, China's coal mine safety production level has encountered bottlenecks, compared with the United States, Australia, South Africa, India and other major coal-producing countries in the world, there is still a big gap. At the same time, China's coal mine safety regulatory authorities to improve the level of supervision also encountered bottlenecks. The main reason for these problems is that there are many problems in the establishment of the legal duties of the coal mine safety supervision department: the division of the legal duties between the central and local governments and the coal mine safety supervision department is not clear and reasonable; The establishment of the statutory duties of the coal mine safety supervision department results in the coal mine safety supervision department exceeding the ability to supervise, and the coal mine safety supervision department lacks the supervision responsibility in some areas. This paper sums up the problems existing in the legal duty setting of coal mine safety supervision department, and analyzes the direct causes and the root causes of these problems. Further put forward the reconstruction of our country's coal mine safety supervision department legal duty assumption: construct the unified coal mine safety supervision law system; Reasonably and clearly define the legal responsibility of coal mine safety supervision between central and local governments and coal mine safety supervision department, reasonably define the compulsory supervision responsibility of coal mine safety supervision department; To increase the responsibility of coal mine safety supervision department to guide and regulate the coal mine safety training market and the coal mine safety technical service market, and to increase the support and guidance responsibility of the coal mine safety supervision department to the coal industry association. By reconstructing the legal responsibility of the coal mine safety supervision department in our country, the supervision level of the coal mine safety supervision department can be improved and the level of coal mine safety production in our country can be improved.
