【摘要】：隨著社會(huì)的發(fā)展,人民生活水平的提高,人民群眾的權(quán)利意識(shí)日益提高,對(duì)公安機(jī)關(guān)的執(zhí)法要求也日益提高。武力的使用是公安執(zhí)法過(guò)程中,非常重要的一環(huán)。現(xiàn)階段我國(guó)公安干警在武力使用上,存在著思想認(rèn)識(shí)不到位導(dǎo)致武力使用失衡;平時(shí)訓(xùn)練不足導(dǎo)致使用武力能力不合格;警械配發(fā)、使用不到位等三大問(wèn)題。面對(duì)現(xiàn)有的人民警察在執(zhí)法過(guò)程中的武力使用問(wèn)題,應(yīng)通過(guò)加強(qiáng)立法使人民警察使用武力時(shí)有法可依;加強(qiáng)與執(zhí)法有關(guān)的訓(xùn)練、提高人民警察自身素質(zhì)和加強(qiáng)對(duì)違法行為的追究以加強(qiáng)人民警察執(zhí)法的合法性與合理性;加強(qiáng)對(duì)人民警察執(zhí)法的宣傳使社會(huì)認(rèn)識(shí)到人民警察執(zhí)法的必要性與正當(dāng)性等方面來(lái)解決現(xiàn)有的武力使用問(wèn)題。
[Abstract]:With the development of the society and the improvement of the people's living standard, the people's consciousness of rights is improving day by day, and the law enforcement requirements of the public security organs are also increasing day by day. The use of force is a very important link in the process of public security law enforcement. At the present stage, there are three problems in the use of force in China's public security police: lack of ideological understanding leads to imbalance in the use of force; lack of training in peacetime leads to unqualified ability to use force; distribution of police equipment and inadequate use of force. In the face of the existing problem of the use of force by the people's police in the course of law enforcement, it is necessary to strengthen legislation to enable the people's police to use force in accordance with the law; and to strengthen training related to law enforcement. Improve the quality of the people's police and strengthen the investigation of illegal acts in order to strengthen the legitimacy and rationality of the people's police law enforcement; Strengthening the propaganda of the people's police law enforcement makes the society realize the necessity and legitimacy of the people's police law enforcement to solve the existing problem of the use of force.
