行政組織法功能的行為法機(jī)制

【摘要】:行政組織法的內(nèi)容包括行政機(jī)關(guān)之間的橫向關(guān)系規(guī)則,但我國(guó)行政組織法并未作出規(guī)定。這是各國(guó)普遍存在的必然現(xiàn)象,解決的路徑是創(chuàng)設(shè)在實(shí)現(xiàn)規(guī)制目標(biāo)的同時(shí)承擔(dān)起相應(yīng)組織法功能的行為法機(jī)制,可以由憲法加普通法、分散的實(shí)體法或者統(tǒng)一行政程序法加以創(chuàng)設(shè)。我國(guó)當(dāng)前的行為法機(jī)制是由分散單行法規(guī)定的,在形式上表現(xiàn)為公文處理制度,在內(nèi)容上表現(xiàn)為各種具體制度。其中,分別審批和審批要件機(jī)制加重了公民負(fù)擔(dān),聯(lián)席會(huì)議、行政協(xié)議和"協(xié)商條款"等未加重公民負(fù)擔(dān)且具有分權(quán)民主和平等協(xié)商的意義。行政組織法功能的行為法機(jī)制之所以存在,有職責(zé)—手段說、分權(quán)合作—民主自治說、信任—授權(quán)說以及制度—社會(huì)說。我國(guó)早期的行為法機(jī)制與計(jì)劃經(jīng)濟(jì)具有密切關(guān)系,多適用于部際關(guān)系;基于簡(jiǎn)政放權(quán)改革后的行為法機(jī)制從部際關(guān)系拓展到區(qū)際關(guān)系。我國(guó)包括行為法機(jī)制在內(nèi)的行政審批已泛濫成災(zāi),必須改革。大部制改革應(yīng)進(jìn)一步深化,行政權(quán)應(yīng)退出市場(chǎng)資源配置,明確地方主體、賦予地方終局性處理權(quán)、按治理需要配置地方事權(quán),減少和優(yōu)化行政機(jī)關(guān)間的橫向關(guān)系,通過統(tǒng)一的行政程序立法整合行為法機(jī)制。
[Abstract]:The content of administrative organic law includes the rules of horizontal relationship between administrative organs, but the administrative organic law of our country has not stipulated it.This is an inevitable phenomenon that exists all over the world. The way to solve this problem is to create a behavioral law mechanism that can fulfill the goal of regulation and assume the functions of the corresponding organic law, which can be added to the common law by the constitution.Decentralized substantive law or unified administrative procedure law to be created.The present behavior law mechanism of our country is regulated by the dispersive single law, which is manifested in the form of official document processing system, and in the content of various concrete systems.Among them, the mechanism of examination and approval and the examination and approval elements increase the burden of citizens, the joint meeting, the administrative agreement and the "negotiation clause" do not increase the burden of citizens and have the significance of decentralized democracy and equal consultation.The existence of the behavioral law mechanism of the function of the administrative organic law includes the theory of responsibility and means, the theory of decentralized cooperation and democratic autonomy, the theory of trust and authorization, and the theory of system-society.The early behavioral law mechanism in China is closely related to the planned economy, and it is mostly applicable to inter-ministerial relations, and the behavioral law mechanism based on the reform of simplified administration and decentralization extends from inter-ministerial to inter-regional relations.The administrative examination and approval, including the mechanism of behavior law, have been overrun and must be reformed.The reform of the large department system should be further deepened, the administrative power should withdraw from the allocation of market resources, the local main body should be clearly defined, the local final handling power should be given, the local administrative authority should be allocated according to the need of governance, and the horizontal relationship between administrative organs should be reduced and optimized.Through the unified administrative procedure legislation to integrate the behavior law mechanism.
