關(guān)于湖南省檢察機關(guān)刑事賠償協(xié)商的調(diào)研報告

【摘要】:刑事賠償協(xié)商是2010年《國家賠償法》修改后,增設(shè)的一項新內(nèi)容。為賠償義務(wù)機關(guān)與賠償請求人在解決刑事賠償糾紛過程中,平等的參與協(xié)商、自由的表達訴求、自愿達成賠償協(xié)議,提供了溝通平臺。對建立完善的刑事賠償制度、化解社會矛盾,促進社會和諧起到了積極作用。 但是從湖南省檢察機關(guān)適用刑事賠償協(xié)商的司法實踐看,由于國家賠償法對刑事賠償協(xié)商規(guī)定過于抽象,可操作性差,導致全省檢察機關(guān)運用協(xié)商解決刑事賠償糾紛的案件比例低,有被人為閑置傾向;在制度設(shè)計上對賠償協(xié)商缺少監(jiān)督機制,導致錯誤運用或濫用協(xié)商,損害國家利益、賠償請求人利益現(xiàn)象突出。在對全省檢察機關(guān)辦理刑事賠償案件適用協(xié)商進行調(diào)查的基礎(chǔ)上,從檢察機關(guān)辦理賠償案件這一特定視角出發(fā),以《國家賠償法》第二十三條為依據(jù),針對立法層面對刑事賠償協(xié)商規(guī)定過于簡單,協(xié)商過程缺少監(jiān)督機制制約,導致司法實踐中各種問題層出不窮的現(xiàn)狀,提出將賠償協(xié)商從國家賠償制度中剝離出來,單獨構(gòu)建刑事賠償協(xié)商制度的設(shè)想,用制度來規(guī)制協(xié)商行為。將監(jiān)督機制引入刑事賠償協(xié)商,以在檢察機關(guān)成熟運作的人民監(jiān)督員制度為依托,讓與案件無任何利益關(guān)聯(lián)的人民監(jiān)督員對協(xié)商過程進行監(jiān)督,保障協(xié)商過程公開、透明,協(xié)商結(jié)果公平、公正,防止賠償義務(wù)機關(guān)或復議機關(guān)損害國家利益或賠償請求人利益;明確刑事賠償協(xié)商的原則,對協(xié)商行為進行有效規(guī)制;對協(xié)商過程進行具體設(shè)計,指引賠償義務(wù)機關(guān)如何開展協(xié)商,解決過去協(xié)商無章可循的局面,規(guī)范賠償義務(wù)機關(guān)或復議機關(guān)的執(zhí)法行為。 希望在調(diào)研基礎(chǔ)上提出的構(gòu)建刑事賠償協(xié)商制度的設(shè)想,能更好發(fā)揮刑事賠償協(xié)商的效能,提高檢察機關(guān)執(zhí)法水平和執(zhí)法能力,這也是執(zhí)法規(guī)范化建設(shè)的必然要求。
[Abstract]:The negotiation of criminal compensation is a new content after the amendment of the State compensation Law in 2010.It provides a communication platform for the compensation obligation organ and the compensation claimant to participate in the consultation freely express their demands freely reach the compensation agreement voluntarily and provide the communication platform in the process of solving the criminal compensation dispute.It has played a positive role in establishing perfect criminal compensation system, resolving social contradictions and promoting social harmony.However, judging from the judicial practice of the procuratorial organs of Hunan Province in applying the consultation on criminal compensation, because the state compensation law is too abstract for the negotiation of criminal compensation, its operability is poor.As a result of the low proportion of cases in which the procuratorial organs in the province use consultation to resolve criminal compensation disputes, and the tendency to be left idle, the lack of supervision mechanism for compensation consultation in the system design leads to the wrong use or abuse of negotiations, thus harming the interests of the state.The phenomenon of compensation claimant's interests is prominent.On the basis of the investigation of the criminal compensation cases handled by the procuratorial organs in the province, the article 23 of the State compensation Law is taken as the basis from the specific angle of view that the procuratorial organs handle the compensation cases.In view of the fact that the legislative level is too simple for the negotiation of criminal compensation and the lack of supervision mechanism in the consultation process leads to the emergence of various problems in judicial practice, it is proposed that the compensation negotiation be separated from the national compensation system.The tentative idea of constructing the negotiation system of criminal compensation alone is to regulate the negotiation behavior with the system.Introducing the supervision mechanism into the criminal compensation negotiation, relying on the people's Supervisor system, which operates mature in the procuratorial organs, giving up the people's supervisors who have no interest in the case to supervise the consultation process, so as to ensure that the consultation process is open and transparent,The result of negotiation is fair and just, preventing the organ of compensatory obligation or reconsideration from harming the national interest or the interests of the claimant; clarifying the principle of criminal compensation negotiation, effectively regulating the negotiation behavior; designing the consultation process concretely,To guide the compensation obligation organization how to carry out the consultation, to solve the situation that there was no rule to follow in the past negotiation, and to standardize the law enforcement behavior of the compensation obligation organ or the reconsideration organ.It is hoped that the assumption of establishing the consultation system of criminal compensation on the basis of investigation and investigation can bring into play the efficiency of criminal compensation negotiation and improve the law enforcement level and ability of procuratorial organs, which is also the inevitable requirement of the construction of law enforcement standardization.
