食品安全治理中公眾參與權(quán)研究

【摘要】:隨著食品安全事件的逐漸增多,公眾的目光逐漸聚焦到食品安全問(wèn)題上。與此同時(shí),食品安全治理中出現(xiàn)的問(wèn)題也被納入到理論研究范疇。2009年《食品安全法》頒布之后,食品安全問(wèn)題也只是得到了部分的解決,可以說(shuō)食品安全問(wèn)題依舊嚴(yán)峻。四年后對(duì)《食品安全法》的修改,主要針對(duì)《食品安全法》實(shí)施后未解決的固有問(wèn)題以及隨著法律實(shí)施產(chǎn)生的新問(wèn)題。理論研究表明食品安全問(wèn)題解決的主要著力點(diǎn)應(yīng)是食品安全監(jiān)管體制的改革,即由傳統(tǒng)的行政監(jiān)管模式向社會(huì)綜合治理模式轉(zhuǎn)變。在這一轉(zhuǎn)向上,社會(huì)共治成了問(wèn)題的關(guān)鍵。加強(qiáng)食品安全中的社會(huì)共治,就是要加強(qiáng)社會(huì)主體,即個(gè)人和團(tuán)體在社會(huì)治理中的作用。誠(chéng)然,這樣的研究在行政法領(lǐng)域已逐步展開(kāi),為了保證公眾參與能夠有效的在政治生活發(fā)揮作用,需要我們關(guān)注將公眾參與作為一項(xiàng)權(quán)利,認(rèn)識(shí)其本質(zhì)以及其運(yùn)行邏輯。 本文認(rèn)為在解決食品安全問(wèn)題時(shí)引入公眾參與制度,并將公眾參與權(quán)作為一項(xiàng)重要的權(quán)利而加以保護(hù),具有理論研究層面的合法性基礎(chǔ),同時(shí)也回應(yīng)了食品安全實(shí)踐的需要。公眾參與權(quán)關(guān)乎人權(quán)、民主、平等等重要的價(jià)值,這些方面的理論發(fā)展為食品安全治理中公眾參與權(quán)的保護(hù)提供了理論上的支撐。同時(shí),從現(xiàn)實(shí)中出現(xiàn)的問(wèn)題著手,我們發(fā)現(xiàn)食品安全監(jiān)管模式中對(duì)行政主體權(quán)力的強(qiáng)調(diào)忽略了作為重要參與者的個(gè)體的權(quán)利,,使得社會(huì)監(jiān)督?jīng)]有發(fā)揮應(yīng)有的作用,出于這一方面的考慮對(duì)公眾參與權(quán)的強(qiáng)調(diào)也是必要的。本文認(rèn)為無(wú)論是對(duì)理論研究的發(fā)展還是對(duì)實(shí)踐問(wèn)題的解決,公眾參與權(quán)的保護(hù)和完善都具有深遠(yuǎn)的意義,主要表現(xiàn)為其能夠打破現(xiàn)存的國(guó)家-企業(yè)的二元監(jiān)管模式,從行動(dòng)者的立場(chǎng)出發(fā)為解決食品安全問(wèn)題提供新的視角。當(dāng)務(wù)之急,是將食品安全治理中的公眾參與作為一項(xiàng)重要的權(quán)利加以保護(hù),明確權(quán)利的內(nèi)容以及性質(zhì),在完善食品安全治理的各項(xiàng)制度中突出對(duì)權(quán)利的保護(hù),通過(guò)政府、企業(yè)以及個(gè)人的共同努力,共擔(dān)責(zé)任,共同解決食品安全問(wèn)題。
[Abstract]:With the increasing number of food safety incidents, public attention is gradually focused on food safety issues. At the same time, the problems in food safety management have also been brought into the category of theoretical research. After the promulgation of the Food Safety Law in 2009, The problem of food safety has only been partially resolved. It can be said that the problem of food safety is still serious. Four years later, the "Food Safety Law" was amended. In view of the problems that have not been solved since the implementation of the Food Safety Law and the new problems arising from the implementation of the law, the theoretical study shows that the main focus of solving the food safety problems should be the reform of the food safety supervision system. That is, from the traditional mode of administrative supervision to the mode of comprehensive social management. In this turn, social co-governance becomes the key to the problem. To strengthen social co-governance in food safety is to strengthen the main body of society. That is, the role of individuals and groups in social governance. Indeed, such research has evolved in the field of administrative law, and in order to ensure that public participation can function effectively in political life, we need to focus on public participation as a right. Understand its essence and its operation logic. This paper holds that the introduction of the system of public participation and the protection of the right of public participation as an important right in solving food safety problems have the legitimacy foundation of theoretical research. It also responds to the need of food safety practice. The right of public participation is related to human rights, democracy, equality and other important values. The development of these theories provides a theoretical support for the protection of the right of public participation in food safety governance. Starting from the problems in reality, we find that the emphasis on the power of the administrative subject in the food safety supervision model neglects the rights of the individual as an important participant, which makes the social supervision not play its due role. It is also necessary to emphasize the right of public participation in this respect. This paper holds that the protection and improvement of the right to participate in public participation is of far-reaching significance both to the development of theoretical research and to the solution of practical problems. Its main performance is that it can break the existing state-enterprise dual regulatory model, from the standpoint of actors to provide a new perspective to solve food safety problems. It is to protect the public participation in food safety governance as an important right, to make clear the content and nature of the right, to give prominence to the protection of rights in the various systems of improving food safety governance, through the government, The joint efforts of enterprises and individuals, shared responsibility, joint solution to food safety problems.
