【摘要】：在生態(tài)文明高速發(fā)展的當(dāng)今社會(huì),ENGO已經(jīng)成為環(huán)境保護(hù)領(lǐng)域的中流砥柱。在環(huán)境法治建設(shè)中,ENGO同樣值得關(guān)注。作為公眾利益的重要表達(dá)者與組織化的社會(huì)力量,致力于環(huán)境保護(hù)公益事業(yè)的ENGO,其影響已經(jīng)滲透在環(huán)保領(lǐng)域的方方面面。ENGO通過(guò)征求意見(jiàn)、聽(tīng)證會(huì)、論證會(huì)等形式參與國(guó)家環(huán)境立法與決策,實(shí)現(xiàn)對(duì)國(guó)家權(quán)力的監(jiān)督與制約。通過(guò)舉報(bào)、環(huán)境公益訴訟等參與環(huán)境立法的實(shí)施,彌補(bǔ)“政府失靈”與“市場(chǎng)失靈”導(dǎo)致的公共實(shí)施的不足。通過(guò)環(huán)境理念的宣傳與培訓(xùn)教育,強(qiáng)化“生態(tài)文明”與“環(huán)境法治”理念的群眾基礎(chǔ)。通過(guò)圓桌會(huì)議等形式,協(xié)調(diào)政府、企業(yè)與民眾環(huán)境利益沖突。ENGO在特定法律關(guān)系中的主體地位已經(jīng)得到學(xué)術(shù)界和法律的認(rèn)可。然而,在實(shí)際運(yùn)行中,由于立法的不完善,ENGO仍面臨登記困難、資金不足等困境,無(wú)法獲得法律保障;同時(shí),空殼ENGO的出現(xiàn),又使ENGO社會(huì)公信力下降,陷入信任危機(jī)的境地。如何有效的應(yīng)對(duì)ENGO的雙重危機(jī),關(guān)乎ENGO的生存發(fā)展。文章從完善現(xiàn)有ENGO參與環(huán)境保護(hù)的模式出發(fā),在充分闡述ENGO的參與范圍、方式的基礎(chǔ)上來(lái)探討我國(guó)ENGO參與環(huán)境保護(hù)的法律規(guī)制問(wèn)題。通過(guò)法治手段的運(yùn)用,結(jié)合美國(guó)、德國(guó)、印度、日本等國(guó)的經(jīng)驗(yàn)與我國(guó)的發(fā)展實(shí)際,從權(quán)利義務(wù)法律完善規(guī)范、資金保障、拓寬社會(huì)監(jiān)督渠道等角度提出可行性的建議,以促使ENGO在法治化軌道內(nèi)規(guī)范運(yùn)行、發(fā)展壯大。
[Abstract]:In the high-speed development of ecological civilization, Ego has become the mainstay of the field of environmental protection.In the construction of environmental rule of law, it is also worth paying attention to.As an important expression of public interest and an organized social force, Engo, which is dedicated to the public welfare of environmental protection, has penetrated into all aspects of the field of environmental protection.The demonstration will participate in the national environmental legislation and decision-making, and realize the supervision and restriction of the state power.Through reporting, environmental public interest litigation and other participation in the implementation of environmental legislation, to make up for "government failure" and "market failure" caused by the lack of public implementation.Through the propaganda and training of the environmental concept, the mass foundation of the concept of "ecological civilization" and "environmental rule by law" is strengthened.Through round tables and other forms to coordinate the conflicts of environmental interests between the government, enterprises and the public. The subject status of ENGO in specific legal relations has been recognized by academia and law.However, in actual operation, due to the imperfect legislation still facing registration difficulties, insufficient funds and other difficulties, unable to obtain legal protection; at the same time, the emergence of shell ENGO, which makes the social credibility of ENGO decline, into the situation of trust crisis.How to effectively deal with the double crisis of ENGO is related to the survival and development of ENGO.Based on the perfection of the existing mode of ENGO participation in environmental protection, this paper discusses the legal regulation of ENGO participation in environmental protection in China on the basis of fully expounding the scope and mode of ENGO participation.Through the use of legal means, combining the experience of the United States, Germany, India, Japan, and other countries and the development reality of our country, put forward some feasible suggestions from the angle of perfecting the law of rights and obligations, improving the norms of law, ensuring funds, widening the channels of social supervision, and so on.In order to promote the ENGO in the rule of law track standard operation, development and growth.
