【摘要】：自改革開放以來,我國的經(jīng)濟(jì)建設(shè)取得了舉世矚目的成就,然而成就背后也隱現(xiàn)著不少問題：社會(huì)貧富差距增大,弱勢群體的生活日益艱難,社會(huì)財(cái)富分配嚴(yán)重?fù)p害了普遍受益這一社會(huì)發(fā)展原則,弱勢群體生存權(quán)利被侵犯的事件時(shí)有發(fā)生,社會(huì)權(quán)利義務(wù)分配失衡。 對(duì)于這些問題,我們應(yīng)該怎么辦?在由傳統(tǒng)秩序行政向現(xiàn)代服務(wù)行政發(fā)展的過程中,行政機(jī)關(guān)如何對(duì)社會(huì)權(quán)利義務(wù)分配進(jìn)行再平衡?怎樣在法治國家建設(shè)的大背景下定位行政救助制度來更好的保障人權(quán)?本文第一部分是行政救助概述,包括行政救助含義、性質(zhì)和適用原則。第二部分是我國健全行政救助制度的必要性,即行政救助的功能分析。第三部分是國外行政救助制度的比較考察,通過介紹國外行政救助的發(fā)展歷程以期獲得借鑒。第四部分是對(duì)我國現(xiàn)行行政救助制度的探討和反思,包括行政救助制度的程序流程和行政救助存在的問題,第五部分是對(duì)行政救助中出現(xiàn)的問題的對(duì)策思考。受限于我國法治化建設(shè)還不夠健全,相關(guān)領(lǐng)域的研究還不夠深入,本文對(duì)行政救助制度做了一個(gè)簡單的探討,略盡綿薄之力。
[Abstract]:Since the reform and opening up, China's economic construction has made remarkable achievements. However, there are still many problems behind the achievements: the gap between the rich and the poor is widening, and the life of the vulnerable groups is becoming increasingly difficult. The distribution of social wealth has seriously damaged the social development principle of universal benefit, and the violation of vulnerable groups' right to exist has occurred from time to time, and the distribution of social rights and obligations is out of balance. What should we do with these questions? In the process of developing from traditional order administration to modern service administration, how do administrative organs rebalance the distribution of social rights and obligations? How to better protect human rights by positioning the administrative aid system under the background of the construction of a country ruled by law? The first part of this paper is an overview of administrative assistance, including the meaning, nature and applicable principles of administrative assistance. The third part is the comparative investigation of foreign administrative aid system, through the introduction of the development of foreign administrative assistance in order to obtain reference. The fourth part is to explore and reflect on the current administrative aid system in China. It includes the procedure flow of administrative aid system and the problems existing in administrative aid system. The fifth part is about the countermeasures to the problems in administrative aid. Limited by the construction of rule of law in our country, the research in related fields is not deep enough. This article has made a simple discussion to the administrative aid system, has made the slight effort.
