【摘要】：國(guó)家監(jiān)察體制改革是事關(guān)全局的重大政治改革,是國(guó)家監(jiān)察制度的頂層設(shè)計(jì)。"凡屬重大改革都要于法有據(jù)",在改革試點(diǎn)實(shí)踐的基礎(chǔ)上制定《國(guó)家監(jiān)察法》確認(rèn)鞏固并全面推行監(jiān)察體制改革成果勢(shì)在必行�！秶�(guó)家監(jiān)察法》立法需要明確六個(gè)基本問(wèn)題:其一,明晰立法目的,國(guó)家監(jiān)察立法以建立集中統(tǒng)一、全面覆蓋、權(quán)威高效、監(jiān)督制約的監(jiān)察體系為目的;其二,明確性質(zhì)定位,國(guó)家監(jiān)察委員會(huì)屬于國(guó)家機(jī)構(gòu),與黨的紀(jì)律檢查委員會(huì)合署辦公;其三,確定職責(zé)屬性,國(guó)家監(jiān)察委員會(huì)專責(zé)行使國(guó)家監(jiān)察職能;其四,界定職權(quán)范圍,國(guó)家監(jiān)察全面覆蓋行使公權(quán)力的公職人員;其五,建立銜接機(jī)制,國(guó)家監(jiān)察委員會(huì)與司法機(jī)關(guān)相協(xié)調(diào)銜接;其六,構(gòu)建監(jiān)督機(jī)制,國(guó)家監(jiān)察權(quán)自身接受黨、人民代表大會(huì)和社會(huì)的監(jiān)督制約。
[Abstract]:The reform of the state supervisory system is a major political reform that has a bearing on the overall situation. It is the top-level design of the state supervision system. "all major reforms must be based on the law." on the basis of the experimental practice of reform, the State Supervision Law was formulated to confirm that it is imperative to consolidate and comprehensively carry out the results of the reform of the supervisory system. <. There are six basic issues that need to be clarified in legislation: first, The purpose of the state supervision legislation is to establish a centralized and unified supervisory system with comprehensive coverage, high authority and high efficiency, and supervision and restriction. Second, it is clear that the nature of the state supervisory committee belongs to the state organ. Co-located with the Party's Disciplinary Inspection Commission; third, to determine the attributes of duties and responsibilities, and the State Supervisory Commission shall be responsible for the exercise of the State supervisory function; fourth, to define the terms of reference and the state supervision will comprehensively cover public officials exercising public power; and fifth, The state supervisory committee should coordinate with the judicial organs; sixthly, the state supervisory authority should be subject to the supervision and restriction of the Party, the people's Congress and the society.
