論行政指導(dǎo)爭議的司法救濟(jì)

【摘要】:行政指導(dǎo)制度以其柔性的管理方法,被大多數(shù)國家廣泛運(yùn)用,同時(shí)對(duì)社會(huì)的發(fā)展產(chǎn)生了積極的影響。在改革開放之初,我國的政府也看到了行政指導(dǎo)對(duì)社會(huì)發(fā)展的重要作用,但當(dāng)時(shí)計(jì)劃經(jīng)濟(jì)給社會(huì)造成不良的影響仍就存在,致使行政指導(dǎo)制度的發(fā)展一度比較緩慢。如今,改革開放已取得了巨大成果,經(jīng)濟(jì)社會(huì)有了較大提高,但要想經(jīng)濟(jì)社會(huì)能持續(xù)增長,也就需要我國加快法治化腳步,這就對(duì)政府管理水平要求會(huì)更高,現(xiàn)實(shí)要求政府在行政管理過程讓普通大眾廣泛參與進(jìn)來。此時(shí),我們的鄰居日本行政指導(dǎo)已經(jīng)基本健全,行政指導(dǎo)在行政管理領(lǐng)域,尤其是經(jīng)濟(jì)領(lǐng)域發(fā)揮了特殊的調(diào)整作用,其他國家也看到了該制度所具有的優(yōu)勢(shì),也紛紛采納并運(yùn)用該行政管理手段,都取得不錯(cuò)的效果。當(dāng)然,我國政府也進(jìn)一步認(rèn)識(shí)到行政指導(dǎo)制度的運(yùn)用不能再遲緩,其靈活性和積極性一定能保證經(jīng)濟(jì)社會(huì)的穩(wěn)步增長,要打破傳統(tǒng)思維,從2000年至今,我國中央政府機(jī)關(guān)紛紛出臺(tái)各種指導(dǎo)性文件,提倡地方政府在社會(huì)管理活動(dòng)實(shí)施行政指導(dǎo),在各領(lǐng)域都取得了良好的效果。 但是,我國行政指導(dǎo)制度在運(yùn)用中還存在諸多的不足,產(chǎn)生行政指導(dǎo)爭議時(shí)常發(fā)生,與行政指導(dǎo)有關(guān)的糾紛也一時(shí)無法妥善解決,行政指導(dǎo)應(yīng)有的作用無法發(fā)揮。行政指導(dǎo)的實(shí)施大多數(shù)以指導(dǎo)性文件為依據(jù),并沒有從立法上對(duì)其實(shí)體內(nèi)容、程序步驟以及救濟(jì)方式予以確立。行政指導(dǎo)在實(shí)務(wù)中的負(fù)面問題,也引起了許多學(xué)者對(duì)行政指導(dǎo)的探究。行政指導(dǎo)的缺陷,一方面是由于行政指導(dǎo)制度的不完善,更重要的是對(duì)行政指導(dǎo)爭議缺乏有效的司法救濟(jì)途徑。無論是學(xué)術(shù)界,還是立法上,都對(duì)行政指導(dǎo)爭議是否給予司法救濟(jì)的途徑意見不統(tǒng)一。筆者嘗試論證行政指導(dǎo)爭議司法救濟(jì)的理論基礎(chǔ)和必要性,表明我國構(gòu)建該制度完全是可行的。同時(shí),總結(jié)行政指導(dǎo)制度實(shí)踐中的多方面問題,指出我國行政指導(dǎo)司法救濟(jì)現(xiàn)狀,在此基礎(chǔ)上表明給予行政指導(dǎo)爭議司法救濟(jì)制度的必要性和迫切性。最后,考察他國行政指導(dǎo)司法救濟(jì)的建立情況,研究可供借鑒的經(jīng)驗(yàn),構(gòu)建我國的行政指導(dǎo)爭議司法救濟(jì)體系,以保障相對(duì)人的合法權(quán)益,進(jìn)一步實(shí)現(xiàn)法治行政。
[Abstract]:The administrative guidance system, with its flexible management method, is widely used in most countries and has a positive impact on the development of society. At the beginning of reform and opening up, our government also saw the important role of administrative guidance in social development. However, at that time, the planned economy had a negative impact on society, resulting in a relatively slow development of the administrative guidance system. Today, great achievements have been made in the reform and opening up, and the economy and society have been greatly improved. However, if we want to achieve sustained economic and social growth, we need our country to speed up the pace of rule of law. This will require a higher level of government management. The reality requires the government to involve the general public extensively in the administrative process. At this time, Our neighbor, Japan, has basically perfected its administrative guidance, which has played a special adjustment role in the field of administration, especially in the economic field. Other countries have also seen the advantages of this system. They have also adopted and used the administrative means one after another, and have achieved good results. Of course, our government has further realized that the application of the administrative guidance system cannot be delayed any longer, and that its flexibility and enthusiasm will surely ensure steady economic and social growth. In order to break the traditional thinking, from 2000 to now, the central government organs of our country have issued various guiding documents one after another, advocating the local government to carry out the administrative guidance in the social management activities, which has achieved good results in all fields. However, there are still many deficiencies in the application of the administrative guidance system in our country. Disputes about administrative guidance often occur, and disputes related to administrative guidance cannot be resolved properly for the time being. The implementation of administrative guidance is mostly based on the guiding documents, and does not establish its substantive content, procedural steps and relief methods from the legislative point of view, and the negative problems in the practice of the administrative guidance. The defects of the administrative guidance are due to the imperfection of the administrative guidance system and, more importantly, the lack of effective judicial remedies to the disputes over administrative guidance. The author tries to prove the theoretical basis and necessity of the judicial remedy of administrative guidance dispute, which indicates that it is completely feasible to construct this system in our country. This paper summarizes the various problems in the practice of administrative guidance system, points out the present situation of judicial relief of administrative guidance in China, and on this basis indicates the necessity and urgency of giving administrative guidance to dispute judicial relief system. This paper reviews the establishment of judicial relief under administrative guidance in other countries, studies the experiences that can be used for reference, and constructs the judicial relief system of administrative guidance disputes in our country in order to protect the legitimate rights and interests of relative persons and further realize the administration by law.
