【摘要】：中國真正形成自己的軍事法治和軍事法學,需要經(jīng)歷三大重構(gòu)工程:一是對中國的軍事法律傳統(tǒng)進行重構(gòu)與創(chuàng)新,二是對西方軍事法律理念和軍事法律制度進行重構(gòu)與創(chuàng)新,三是對中國的軍事法律現(xiàn)實進行重構(gòu)與創(chuàng)新。這種重構(gòu)是指在深度反思、具體辨析和整體把握的基礎(chǔ)上,對古今中外的軍事法律義理、軍事法律制度和軍事法律文化進行篩選、加工、升華和整合,從而形成中國的軍事法治模式和軍事法學理論。
[Abstract]:In order to form its own military rule of law and military jurisprudence, China needs to undergo three major reconstruction projects: one is to reconstruct and innovate China's military legal tradition, the other is to reconstruct and innovate the western military legal concepts and systems. The third is to reconstruct and innovate the reality of military law in China. This kind of reconstruction refers to the screening of military legal justice, military legal system and military legal culture in ancient, modern and foreign countries on the basis of deep reflection, concrete analysis and overall grasp. Processing, sublimation and integration, thus forming China's military rule of law model and military jurisprudence theory.
