【摘要】：社會(huì)力量設(shè)立科技獎(jiǎng)勵(lì)作為政府設(shè)獎(jiǎng)的有力補(bǔ)充,已成為我國科技獎(jiǎng)勵(lì)的重要組成部分,對(duì)于引導(dǎo)和推進(jìn)技術(shù)進(jìn)步、人才培養(yǎng)和產(chǎn)業(yè)發(fā)展,都發(fā)揮著極為重要的作用。但是目前與科技獎(jiǎng)勵(lì)相關(guān)的法律法規(guī),都以政府設(shè)獎(jiǎng)為主要內(nèi)容,對(duì)社會(huì)力量設(shè)獎(jiǎng)少有涉及,社會(huì)力量設(shè)獎(jiǎng)的發(fā)展面臨障礙,依靠社會(huì)力量設(shè)獎(jiǎng)自身已難以打破困境,亟需對(duì)其進(jìn)行法律規(guī)制。本文致力于探討社會(huì)力量設(shè)獎(jiǎng)的法律規(guī)制,具體包括：完善相關(guān)立法,包括實(shí)體性法律和程序性法律；明確行政管理主體的權(quán)利和義務(wù),以提供支持和幫助為目的,以監(jiān)督管理為手段,保障社會(huì)力量設(shè)獎(jiǎng)良性發(fā)展；打造崇尚科學(xué)技術(shù)的社會(huì)大環(huán)境,引導(dǎo)社會(huì)力量設(shè)獎(jiǎng)走向法制化、規(guī)范化。本文著眼于我國社會(huì)力量設(shè)獎(jiǎng)的現(xiàn)狀,借鑒國外成功經(jīng)驗(yàn),給出了切實(shí)可行的對(duì)策,力求對(duì)社會(huì)力量設(shè)獎(jiǎng)有所助益。
[Abstract]:The establishment of scientific and technological awards by social forces as a powerful supplement to government awards has become an important part of our country's scientific and technological awards, which has served to guide and promote technological progress, talent training and industrial development. Both play an extremely important role. But at present, the laws and regulations related to the award of science and technology all take the government award as the main content, and rarely involve the establishment of awards for social forces, and the development of the awards for social forces is facing obstacles. It is difficult to break down the predicament by relying on the social force to set up the prize itself, so it is urgent to regulate it. This article is devoted to discussing the legal regulation of the social force award, including: perfecting the relevant legislation, including substantive law and procedural law; To make clear the rights and obligations of administrative subjects, to provide support and help, to ensure the healthy development of social forces by means of supervision and management, to create a social environment that advocates science and technology, This paper focuses on the present situation of social force awards in China, draws lessons from the successful experience of foreign countries, and puts forward practical countermeasures to help the establishment of awards for social forces.
