【摘要】：推進(jìn)國家監(jiān)察立法的研究已比較深入,有些意見已獲我國法學(xué)界普遍認(rèn)同。監(jiān)察體制改革是我國政治體制的重大改革,沒必要搶時間趕進(jìn)度,也不必趕在下一屆全國人民代表大會召開時通過改革國家監(jiān)察體制所需的法律�？梢钥紤]將全國人大審議表決監(jiān)察立法的時間推遲到2019年或更晚。如果為建立國家監(jiān)察體制而修改憲法、制定相關(guān)法律的路線圖時間表不能調(diào)整,也完全可以理解,不過,此種情勢下最好制定出一部包括監(jiān)察機(jī)關(guān)組織、權(quán)限,監(jiān)察程序和監(jiān)察官等方面內(nèi)容的綜合監(jiān)察法,應(yīng)考慮從制定綜合性的監(jiān)察法的形式、調(diào)整對象的范圍、職權(quán)、工作責(zé)任制等十四個具體方面完善現(xiàn)有的改革設(shè)想。
[Abstract]:The research on the promotion of state supervision legislation has been thoroughly studied, and some opinions have been generally accepted by the legal circles of our country. The reform of the supervisory system is a major reform of the political system of our country, and there is no need to rush the time to catch up with the progress. Nor does it have to be in time for the next NPC to pass the laws needed to reform the state supervisory system. Consider postponing the NPC review and voting on supervisory legislation to 2019 or later, if it is for the establishment of a country. To amend the Constitution, It is entirely understandable that the road map timetable for the formulation of relevant laws cannot be adjusted. However, in such a situation, it would be better to formulate a comprehensive supervisory law that includes the organization, competence, supervisory procedures and supervisory officer of the supervisory organ. Consideration should be given to perfecting the existing reform ideas from 14 concrete aspects, such as the formulation of a comprehensive supervision law, the scope of the adjustment object, the authority and the work responsibility system, etc.
