行政指導(dǎo)的立法研究

【摘要】:二十世紀(jì)五六十年代以來(lái),隨著現(xiàn)代市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展和民主政治程度的逐漸加深,在社會(huì)管理領(lǐng)域很多創(chuàng)新的理論和方法層出不窮以滿足社會(huì)需求。在行政實(shí)務(wù)中,由于行政指導(dǎo)日益顯現(xiàn)出的特殊功能,從前對(duì)行政指導(dǎo)持否定態(tài)度的國(guó)家開(kāi)始關(guān)注與研究行政指導(dǎo)在經(jīng)濟(jì)領(lǐng)域的運(yùn)用,以促進(jìn)市場(chǎng)經(jīng)濟(jì)的發(fā)展。20世紀(jì)80年代,我國(guó)由計(jì)劃經(jīng)濟(jì)體制向市場(chǎng)經(jīng)濟(jì)體制轉(zhuǎn)變,使行政機(jī)關(guān)及其公務(wù)人員在行政管理活動(dòng)中逐漸采用了一些比較靈活、不具有強(qiáng)制性的行政管理方式,如行政指導(dǎo),并顯現(xiàn)出特殊的可行性和實(shí)效性。同時(shí),隨著行政實(shí)務(wù)的發(fā)展,行政指導(dǎo)的缺陷和負(fù)面效應(yīng)也逐漸地顯露出來(lái),引起學(xué)術(shù)界的關(guān)注和爭(zhēng)論。本文以理論探討為主,兼顧實(shí)務(wù)問(wèn)題。 本文除緒論外,包括四大部分: 第一部分,主要是對(duì)行政指導(dǎo)的基本理論進(jìn)行闡釋。首先,在分析了國(guó)內(nèi)外知名學(xué)者對(duì)行政指導(dǎo)的概念界定的基礎(chǔ)上,提出自己對(duì)行政指導(dǎo)的認(rèn)識(shí)。其次,對(duì)行政指導(dǎo)的性質(zhì)進(jìn)行辨析,認(rèn)為行政指導(dǎo)應(yīng)該是非權(quán)力性行政行為。再次,闡述行政指導(dǎo)具有補(bǔ)充法律空域,行為引導(dǎo)、誘導(dǎo),協(xié)調(diào)利益矛盾的功能。第四,將行政指導(dǎo)與其他非強(qiáng)制性行政行為進(jìn)行比較,如行政合同和行政獎(jiǎng)勵(lì)與行政指導(dǎo)之間的關(guān)聯(lián)性。最后,立足于我國(guó)特色社會(huì)主義初級(jí)階段的基本國(guó)情,分析出我國(guó)行政指導(dǎo)立法的可行性與必要性。 第二部分,依據(jù)我國(guó)現(xiàn)階段有關(guān)行政指導(dǎo)的法律規(guī)范,指出其中存在的問(wèn)題,包括行政指導(dǎo)的法律規(guī)范化程度不高,行政指導(dǎo)的監(jiān)督、救濟(jì)機(jī)制不完善,行政指導(dǎo)透明度低、公眾參與度低等,并總結(jié)出原因。 第三部分,在借鑒國(guó)外優(yōu)秀行政指導(dǎo)立法經(jīng)驗(yàn)的基礎(chǔ)上,總結(jié)出對(duì)我國(guó)行政指導(dǎo)立法的啟示,主要有三方面:一是完善行政指導(dǎo)的法律規(guī)范建設(shè);二是建立健全相應(yīng)的監(jiān)督救濟(jì)機(jī)制;三是提高公民在立法過(guò)程中的參與程度。 第四部分,針對(duì)行政指導(dǎo)立法提出構(gòu)想。本文從三個(gè)方面提出行政指導(dǎo)的立法構(gòu)想,分別是確立行政指導(dǎo)立法的基本原則、行政指導(dǎo)的制度建構(gòu)以及行政指導(dǎo)的程序及其監(jiān)督救濟(jì)。
[Abstract]:Since 20th century, with the continuous development of modern market economy and the deepening of democratic politics, many innovative theories and methods have emerged in the field of social management to meet the needs of society. Due to the special function of administrative guidance, countries that used to hold negative attitude towards administrative guidance began to pay attention to and study the application of administrative guidance in the economic field, in order to promote the development of market economy in 80s. The transition from the planned economy system to the market economy system has made the administrative organs and their public servants gradually adopt some more flexible and non-compulsory administrative methods, such as administrative guidance, in their administrative activities. At the same time, with the development of administrative practice, the defects and negative effects of administrative guidance are gradually revealed, which has aroused the attention and controversy of academic circles. Consideration should be given to practical issues. In addition to the introduction, this paper includes four parts:. The first part is mainly to explain the basic theory of administrative guidance. Firstly, on the basis of analyzing the definition of the concept of administrative guidance by famous scholars at home and abroad, the author puts forward his own understanding of administrative guidance. Based on the analysis of the nature of administrative guidance, the author thinks that administrative guidance should be a non-power administrative act. Thirdly, it expounds that administrative guidance has the functions of supplementary legal airspace, behavioral guidance, inducement and coordination of conflicts of interests. 4th, Comparing administrative guidance with other non-compulsory administrative acts, such as the relationship between administrative contract and administrative reward and administrative guidance. Finally, based on the basic national conditions of the primary stage of socialism with Chinese characteristics, This paper analyzes the feasibility and necessity of our country's administrative guidance legislation. The second part, according to the current legal norms of administrative guidance in our country, points out the existing problems, including the low degree of legal standardization of administrative guidance, supervision of administrative guidance, imperfect relief mechanism and low transparency of administrative guidance. Public participation is low and reasons are summed up. The third part, on the basis of drawing lessons from the foreign excellent administrative guidance legislation experience, summarizes the enlightenment to our country's administrative guidance legislation, mainly has three aspects: first, consummates the administrative guidance legal norm construction; The second is to establish and improve the corresponding supervision and relief mechanism, and the third is to improve the participation of citizens in the legislative process. In the 4th part, the author puts forward the conception of the administrative guidance legislation from three aspects, which are the basic principles of establishing the administrative guidance legislation. The system construction of administrative guidance, the procedure of administrative guidance and its supervision relief.
