【摘要】：社會法的訴訟機制與社會權(quán)訴訟密切相關(guān)。社會權(quán)的發(fā)展有一個從道德權(quán)利到法律權(quán)利、從應然權(quán)利到實然權(quán)利、從不可訴權(quán)利到可訴權(quán)利的演進過程,由此形成并決定了社會法獨特的訴訟機制。與其他部門法相比,社會法在訴訟機構(gòu)設置、訴訟程序、訴訟機理和訴訟主體資格認定方面有很大的不同。不僅如此,社會法上的訴權(quán)并非完全的權(quán)利,而是受到了一定限制。因為社會法上的權(quán)利實現(xiàn)取決于社會發(fā)展的總體水平,不能超出社會的經(jīng)濟結(jié)構(gòu)以及由經(jīng)濟結(jié)構(gòu)所制約的社會文化發(fā)展程度。
[Abstract]:The litigation mechanism of social law is closely related to the litigation of social rights. The development of social rights has an evolutionary process from moral right to legal right, from ought right to actual right, from never actionable right to actionable right. Compared with other branch laws, the social law has great differences in the establishment of litigation institutions, the procedure, the mechanism of litigation and the qualification of litigant. The right of action in social law is not a complete right, but is limited, because the realization of the right in social law depends on the overall level of social development. Must not exceed the social economic structure and the social and cultural development level restricted by the economic structure.
