【摘要】：兒童食物權(quán)作為一項(xiàng)基本人權(quán),是《經(jīng)濟(jì)、社會(huì)與文化權(quán)利國(guó)際公約》與《兒童權(quán)利國(guó)際公約》中確認(rèn)適當(dāng)生活水準(zhǔn)權(quán)的一部分。兒童食物權(quán)的權(quán)利屬性,要求國(guó)家予以尊重和保護(hù)。我國(guó)當(dāng)前主要通過(guò)憲法以及各部門法間接保護(hù)兒童食物權(quán),但兒童處于人生的特殊階段,食物是兒童踏入成年人生活必不可少的條件,法律沒(méi)有明確規(guī)定兒童食物權(quán),使得兒童獲得安全和營(yíng)養(yǎng)的食物,在實(shí)體法上與程序法上的救濟(jì)都存在困境。 本文主要分四個(gè)部分來(lái)闡述兒童食物權(quán)： 第一章“緒論”,闡述研究?jī)和澄餀?quán)的現(xiàn)實(shí)意義以及理論的必要性,對(duì)兒童食物權(quán)的研究現(xiàn)狀進(jìn)行簡(jiǎn)單梳理,為后續(xù)研究提供思路。 第二章“兒童食物權(quán)概述”,圍繞“什么是兒童食物權(quán)”展開(kāi),對(duì)兒童食物權(quán)的內(nèi)涵與內(nèi)容進(jìn)行論述。 第三章“兒童食物權(quán)在我國(guó)的實(shí)現(xiàn)”從法學(xué)理論角度闡述我國(guó)對(duì)兒童食物權(quán)保障的基本情況,并以學(xué)校營(yíng)養(yǎng)午餐為例提出當(dāng)前兒童食物權(quán)保障存在問(wèn)題。 第四章“完善我國(guó)兒童食物權(quán)保障制度建議”。對(duì)完善我國(guó)兒童食物權(quán)提出立法、執(zhí)法、構(gòu)建評(píng)估體系、文化培植方面的措施與途徑,解決怎樣保護(hù)兒童食物權(quán)的問(wèn)題。
[Abstract]:The right of the child to food, as a fundamental human right, is part of the recognition of the right to an adequate standard of living in the International Covenant on Economic, Social and Cultural Rights and the International Covenant on the Rights of the Child... the right to food of the child, The State is required to respect and protect... the right to food is indirectly protected mainly through the Constitution and various sectoral laws in our country, but children are at a special stage of their lives, and food is an indispensable condition for children to enter into adult life. Children's right to food is not clearly stipulated in the law, so that children can obtain safe and nutritious food, and there are difficulties in substantive law and procedural law. This paper mainly discusses the right to food of children in four parts:. The first chapter "introduction" expounds the practical significance and theoretical necessity of the study of children's right to food, and briefly combs the current situation of research on children's right to food, which provides ideas for further research. The second chapter, "the summary of children's right to food", focuses on "what is the right to food for children", and discusses the connotation and content of children's right to food. Chapter three, "the realization of Children's right to Food in China", expounds the basic situation of the guarantee of children's right to food from the angle of legal theory, and points out the problems existing in the guarantee of children's right to food by taking the school nutritious lunch as an example. Chapter 4th, "suggestions on perfecting the system of Children's right to Food in China", puts forward legislation, law enforcement, construction of evaluation system, cultural cultivation measures and ways to solve the problem of how to protect children's right to food.
