公共治理視角下的上海公共場(chǎng)所禁煙問(wèn)題研究

【摘要】:2012年5月30日,衛(wèi)生部在首次發(fā)布的《中國(guó)吸煙危害健康報(bào)告》指出,當(dāng)前我國(guó)因吸食煙草死于與其有關(guān)的疾病的人數(shù)超過(guò)120萬(wàn)人,幾乎平均下來(lái)每天超過(guò)3000人,吸食香煙及類似制品是首要死因。報(bào)告顯示,我國(guó)大約7.4億非吸煙人群正在遭受二手煙的危害,,而公共場(chǎng)所又是二手煙高發(fā)的最嚴(yán)重的地方,推行公共場(chǎng)所經(jīng)驗(yàn)已經(jīng)刻不容緩的事實(shí)。上海作為中國(guó)面對(duì)世界的最為重要的窗口之一,推進(jìn)上海的公共場(chǎng)所禁止吸煙不僅是彰現(xiàn)這個(gè)中國(guó)國(guó)際化大都市社會(huì)文明的標(biāo)志,更是政府和諧執(zhí)政的重要表現(xiàn)。 本文立足于中國(guó)作為全世界香煙生產(chǎn)量最大的國(guó)家,全球的香煙接近一半的由中國(guó)生產(chǎn),且中國(guó)吸食二手煙的受害者也已高達(dá)7.4億;雖然中國(guó)已經(jīng)簽訂了《世界衛(wèi)生組織煙草控制框架公約》,但該公約在中國(guó)生效6年的時(shí)間以來(lái),一直沒(méi)有什么效果,而且我國(guó)至今仍然沒(méi)有一部國(guó)家意義上的禁止吸食香煙的法律文件,同時(shí)相關(guān)部門(mén)政企不分,煙草稅額快速增長(zhǎng)而價(jià)格一成不變、煙草文化一直在延續(xù),全民吸食香煙率不僅沒(méi)有降低,被動(dòng)吸食香煙者卻在急速增長(zhǎng)的背景,從公共治理視角入手,對(duì)公共場(chǎng)所禁煙的實(shí)質(zhì)進(jìn)行分析,并闡述了公共場(chǎng)所禁煙的必要性及危害性,同時(shí)對(duì)上海市目前公共場(chǎng)所禁煙的現(xiàn)狀進(jìn)行考察分析,在借鑒國(guó)外公共場(chǎng)所禁煙經(jīng)驗(yàn)的基礎(chǔ)上,對(duì)上海市推進(jìn)公共場(chǎng)所禁煙提出了對(duì)策。 本文主要分為六個(gè)部分:第一部分介紹了論文的選題背景和研究意義,并提出論文的研究思路和研究框架。然后對(duì)國(guó)內(nèi)外就此課題的研究的理論進(jìn)行分類綜述和探討;第二部分論文闡述了公共場(chǎng)所禁止吸煙的實(shí)質(zhì),先從公共場(chǎng)所的基本內(nèi)涵進(jìn)行分析入手,指出公共場(chǎng)所禁止吸煙事實(shí)上即個(gè)人利益和公共利益的博弈,并對(duì)此運(yùn)用公共關(guān)系理論進(jìn)行深入細(xì)致的分析;第三部分運(yùn)用公共關(guān)系理論對(duì)上海當(dāng)前存在的公共場(chǎng)所禁止吸煙現(xiàn)狀的考察和仔細(xì)分析;第四部分對(duì)當(dāng)今一些禁止吸煙工作開(kāi)展的比較卓有成效的國(guó)家或者地區(qū)進(jìn)行調(diào)研和分析總結(jié)其成功經(jīng)驗(yàn);第五部分推進(jìn)上海公開(kāi)場(chǎng)所禁止吸食香煙的建議策略,最后一部分是全文的總結(jié)與展望。 本論文的研究對(duì)象是上海公共場(chǎng)所禁煙現(xiàn)狀,考慮到上海市是國(guó)家經(jīng)濟(jì)、金融中心,其研究結(jié)果不但能為上海市公開(kāi)場(chǎng)所禁止吸食香煙立法、執(zhí)法等提供理論和數(shù)據(jù)參考,還可以深入探究具有普遍意義的禁止在公開(kāi)場(chǎng)所吸食香煙工作順利發(fā)展的積極對(duì)策,使得進(jìn)一步制定和完善針對(duì)國(guó)家和地區(qū)的公開(kāi)場(chǎng)所禁止吸食香煙法規(guī)有了堅(jiān)實(shí)的理論基礎(chǔ)。
[Abstract]:In May 30th 2012, the Ministry of Health issued the first "China smoking Health report" pointed out that the current number of people who died from tobacco related diseases in China is more than 1.2 million. Smoking cigarettes and similar products is the leading cause of death on the average of more than 3 people a day. The report shows that about 740 million non-smokers in China are suffering from secondhand smoke. And the public place is the most serious place of the high incidence of second-hand smoke, it is urgent to implement the experience of the public place. Shanghai is one of the most important windows for China to face the world. Promoting the ban on smoking in public places in Shanghai is not only a sign of social civilization in China's cosmopolitan metropolis, but also an important manifestation of the harmonious governance of the government. Based on the fact that China is the country with the largest production of cigarettes in the world, nearly half of the cigarettes in the world are produced in China, and the number of victims of secondhand smoke in China has reached as high as 740 million. Although China has signed the WHO Framework Convention on Tobacco Control, it has had little effect since it came into force in China six years ago. And China still does not have a national significance of the prohibition of smoking cigarettes legal documents, at the same time relevant departments do not distinguish between government and enterprises, tobacco tax growth and price unchanged, tobacco culture has been continuing. The national smoking rate of cigarettes has not decreased, passive smokers are growing rapidly in the background, from the perspective of public governance, the essence of smoking prohibition in public places is analyzed. The necessity and harmfulness of smoking prohibition in public places are expounded. At the same time, the current situation of smoking prohibition in public places in Shanghai is investigated and analyzed, on the basis of drawing lessons from the experience of smoking prohibition in foreign public places. The countermeasures are put forward to promote smoking ban in public places in Shanghai. This paper is divided into six parts: the first part introduces the background and significance of the thesis. And put forward the research ideas and research framework. Then the domestic and foreign research on the theory of this subject are summarized and discussed. The second part of the paper expounds the essence of smoking prohibition in public places, starting with the analysis of the basic connotation of public places, and points out that smoking prohibition in public places is in fact the game between personal interests and public interests. And use the public relations theory to carry on the thorough and meticulous analysis to this; The third part uses the theory of public relations to investigate and analyze the current situation of smoking prohibition in public places in Shanghai. Part 4th studies and summarizes the successful experiences of some countries or regions that have carried out the work of banning smoking. The last part is the summary and prospect of the whole paper. The research object of this paper is the current situation of smoking ban in public places in Shanghai. Considering that Shanghai is a national economic and financial center, its research results can not only prohibit smoking in public places in Shanghai. Law enforcement provides theoretical and data reference, but also can explore the general significance of the prohibition of smoking cigarettes in public places, the smooth development of the positive countermeasures. The further development and improvement of national and regional public smoking ban smoking regulations have a solid theoretical basis.
