【摘要】：大氣環(huán)境容量資源作為一種稀缺的公共資源,具有消費的非競爭性和非排他性,個體理性與集體理性之間的矛盾導致其在資源配置中存在市場失靈的情況,需要國家以經濟法的形式干預大氣環(huán)境容量資源配置�？紤]到政府干預界限應該與法治能力相一致,大氣污染控制制度設計應界定政府經濟人界限,合理進行收費權、處罰權等部門配置,避免部門爭權奪利而影響監(jiān)管效率;界定經濟法干預成本界限,定量化對比政府干預行為的成本與收益,選擇理性干預;加大大氣控制制度處罰力度,處罰數額高于其治污成本的2倍以上,保障制度的有效性;實現(xiàn)大氣污染總量控制,促進產業(yè)結構優(yōu)化升級和技術進步,有效控制大氣污染,改善大氣環(huán)境質量。
[Abstract]:As a scarce public resource, the atmospheric environmental capacity resource has the non-competitive and non-exclusive nature of consumption. The contradiction between individual rationality and collective rationality leads to the market failure in the allocation of resources. It is necessary for the state to intervene in the allocation of atmospheric environmental capacity resources in the form of economic law. Considering that the limit of government intervention should be consistent with the ability of ruling by law, the design of air pollution control system should define the limits of government economic man. Reasonable allocation of charge right, penalty right and other departments, to avoid the department competing for profit and affect the efficiency of supervision; Define the cost limit of economic law intervention, compare the cost and benefit of government intervention, choose rational intervention; Increasing the punishment of atmospheric control system, the amount of punishment is more than 2 times of its pollution control cost, and the effectiveness of the protection system; To control the total amount of air pollution, to promote the optimization and upgrading of industrial structure and technological progress, to effectively control air pollution and improve the quality of the atmosphere environment.
