【摘要】：從廣義上理解,我國環(huán)境監(jiān)管包括統(tǒng)一監(jiān)督與分部門、分級(jí)相結(jié)合的行政監(jiān)管,以及立法機(jī)關(guān)、行政機(jī)關(guān)、司法機(jī)關(guān)組成的國家監(jiān)督和政黨、社會(huì)組織、公眾、新聞媒體等組成的非國家監(jiān)督。但如此龐大的環(huán)境行政監(jiān)管和環(huán)境法治監(jiān)督體系未能根本改變我國生態(tài)環(huán)境惡化的趨勢(shì),因而有必要跳出制度設(shè)計(jì)本身,引入相關(guān)的社會(huì)科學(xué)前沿理論——社會(huì)資本理論,把環(huán)境監(jiān)管放在社會(huì)資本的網(wǎng)絡(luò)關(guān)系中研究。從社會(huì)資本的網(wǎng)絡(luò)視角來看,環(huán)境監(jiān)管的困境體現(xiàn)為網(wǎng)絡(luò)缺失,即網(wǎng)絡(luò)的封閉性不足和"結(jié)構(gòu)洞"過多、權(quán)威關(guān)系不足與權(quán)威關(guān)系過度并存、縱橫向網(wǎng)絡(luò)與強(qiáng)弱關(guān)系的結(jié)構(gòu)不盡合理。走出環(huán)境監(jiān)管的困境,需要推動(dòng)國家法團(tuán)主義走向社會(huì)法團(tuán)主義來優(yōu)化環(huán)境監(jiān)管的網(wǎng)絡(luò)關(guān)系,發(fā)揮國家、社會(huì)和公民的協(xié)同作用,以增加環(huán)境監(jiān)管的社會(huì)資本投入。
[Abstract]:In a broad sense, China's environmental supervision includes unified supervision and sub-departments, administrative supervision combined with classification, as well as state supervision and political parties, social organizations, and the public composed of legislature, executive and judicial organs. However, such a huge environmental administrative supervision and environmental legal supervision system can not fundamentally change the trend of the deterioration of the ecological environment in China, so it is necessary to jump out of the system design itself. This paper introduces the relevant frontier theory of social sciences-social capital theory, and studies the environmental supervision in the network relationship of social capital. From the perspective of social capital, the predicament of environmental regulation is reflected in the lack of network. That is, the closure of the network and the "structure hole" too much, the relationship between authority and authority co-exist too much, the vertical and horizontal network and the relationship between strength and weakness structure is not reasonable, out of the plight of environmental regulation. In order to increase the social capital investment of environmental supervision, it is necessary to improve the network relationship of environmental supervision and bring into play the synergetic effect of state, society and citizens.
