【摘要】：醫(yī)鬧事件頻發(fā),嚴(yán)重傷害、殺害醫(yī)務(wù)人員的事件讓"醫(yī)鬧"入刑成為必然。刑法修正案(九)草案,擬將"醫(yī)鬧"納入"聚眾擾亂社會(huì)秩序罪"中。然而這個(gè)罪名無法涵蓋"醫(yī)鬧"行為所有的主體方面和客觀方面。建議刑法單獨(dú)設(shè)立"聚眾擾亂醫(yī)療秩序罪",并在此罪中設(shè)轉(zhuǎn)化犯。另外完善相關(guān)行政法律法規(guī),形成行政處罰與刑事處罰的銜接。
[Abstract]:Frequent medical incidents, serious injuries, the killing of medical personnel incidents so that "medical trouble" into prison is inevitable. Draft amendment (9) to the criminal law, it is intended to include "medical disturbance" into the crime of crowd disturbance of social order. However, this charge can not cover all the subjective and objective aspects of the "medical disturbance" behavior. It is suggested that the criminal law should set up the crime of congregation and disturbing medical order, and set up the transmutation crime in this crime. In addition, improve the relevant administrative laws and regulations, form the administrative punishment and criminal punishment of the convergence.
