【摘要】：走私犯罪是一種嚴(yán)重破壞國家正常經(jīng)濟(jì)秩序的犯罪行為,而且敗壞社會風(fēng)氣,滋生腐敗現(xiàn)象,在經(jīng)濟(jì)上和政治上都有極大的危害性。本文試圖以廣西崇左邊境地區(qū)的走私犯罪為研究客體,運(yùn)用刑法理論,重點(diǎn)對廣西內(nèi)陸邊境地區(qū)走私活動的成因及現(xiàn)狀進(jìn)行分析,提出邊境地區(qū)預(yù)防及打擊走私犯罪活動的對策及建議,希望給廣西反走私工作提供借鑒參考,起到示范作用。本文將分成四個部分對廣西崇左邊境地區(qū)走私犯罪及預(yù)防打擊的對策建議進(jìn)行闡述。第一部分,對廣西崇左邊境地區(qū)走私犯罪進(jìn)行了總體情況概述。從走私活動發(fā)生的原理,對廣西崇左邊界地區(qū)的地域進(jìn)行了界定,對崇左邊境地區(qū)經(jīng)濟(jì)發(fā)展水平及在我國邊境地區(qū)的重要地位進(jìn)行了概括；對廣西崇左邊境地區(qū)走私犯罪的共性進(jìn)行深入剖析,歸納為“繞越設(shè)關(guān)地走私、互市貿(mào)易渠道走私、毒品走私”三大共性,使我們對崇左邊境地區(qū)走私犯罪總體情況有了完整的了解。第二部分,對崇左邊境各轄區(qū)走私犯罪的現(xiàn)狀與特點(diǎn)進(jìn)行分析。從地域入手,對憑祥市、寧明、龍州、大新縣各種轄區(qū)內(nèi)走私犯罪的現(xiàn)狀與特點(diǎn)進(jìn)行詳細(xì)闡述,從這些論述中,了解到崇左邊境地區(qū)由于微觀地域的差異,走私犯罪活動呈現(xiàn)不同的特點(diǎn)。第三部分,主要分析廣西崇左邊境地區(qū)走私犯罪的原因。從境內(nèi)外價差、經(jīng)濟(jì)發(fā)展水平、邊防管控、越南對走私活動的政策扶持等方面剖析,找出崇左邊境地區(qū)走私犯罪活動相對活躍的原因,以便我們在提出對策時對癥下藥。第四部分,主要針對崇左邊境地區(qū)走私犯罪發(fā)生的原因及現(xiàn)狀,提出加強(qiáng)反走私工作的對策及建議。在機(jī)制保障上,提出創(chuàng)新緝私體制,推動反走私綜合治理；在“硬件”上,強(qiáng)調(diào)完善邊境管控機(jī)制,加強(qiáng)國防基礎(chǔ)建設(shè)；在“軟件”上,建議政府層面制定具體措施,促進(jìn)邊境經(jīng)濟(jì)繁榮；加強(qiáng)國際交流合作,進(jìn)一步深化走私源頭治理；切實(shí)加強(qiáng)海關(guān)緝私部門打擊走私能力建設(shè),充分發(fā)揮把好國門職責(zé)。唯有如此,才能更好地強(qiáng)化崇左邊境地區(qū)反走私工作,推動崇左邊境地區(qū)可持續(xù)健康發(fā)展。
[Abstract]:The crime of smuggling is a kind of criminal behavior which seriously damages the normal economic order of the country, and corrupts the social atmosphere and breeds the phenomenon of corruption, which has great harmfulness in economy and politics. Taking the smuggling crime in Chongzuo border area of Guangxi as the research object, this paper, using the theory of criminal law, focuses on the analysis of the causes and present situation of the smuggling activities in the inland border area of Guangxi. This paper puts forward the countermeasures and suggestions for preventing and cracking down on smuggling in border areas, hoping to provide reference for Guangxi anti-smuggling work and play an exemplary role. This article will be divided into four parts to explain the crime of smuggling in Chongzuo border area of Guangxi and the countermeasures and suggestions to prevent the attack. In the first part, the general situation of smuggling crime in Chongzuo border area of Guangxi is summarized. Based on the principle of smuggling, this paper defines the region of Chongzuo border area in Guangxi, summarizes the level of economic development in Chongzuo border area and its important position in the border area of our country. The common character of smuggling crime in Chongzuo border area of Guangxi is deeply analyzed, which is summed up as "smuggling around closed areas, smuggling through trade channels of mutual markets, and drug smuggling." So that we have a complete understanding of the overall situation of smuggling crime in Chongleft border area. The second part analyzes the current situation and characteristics of smuggling crime in Chongzuo Border area. Starting with the region, this paper expounds in detail the present situation and characteristics of smuggling crimes in various jurisdictions of Pingxiang City, Ningming City, Longzhou County and Daxin County. From these expositions, we can understand the differences in the Chongzuo border area due to the microregional differences. The criminal activities of smuggling show different characteristics. The third part, mainly analyzes the reason of smuggling crime in Chongzuo border area of Guangxi. This paper analyzes the price difference inside and outside the country, the level of economic development, border control and Vietnam's policy support for smuggling activities, and finds out the reasons for the relatively active criminal activities of smuggling in Chongleftist border area, so that when we put forward countermeasures, we can put forward the right remedy to the case. In the fourth part, the author puts forward the countermeasures and suggestions to strengthen the anti-smuggling work in view of the causes and present situation of smuggling crime in Chongzuo border area. In the aspect of mechanism guarantee, it is proposed to innovate the anti-smuggling system and to promote the comprehensive control of anti-smuggling, and in the "hardware", the emphasis should be placed on perfecting the border control mechanism and strengthening the national defense infrastructure. On the "software", it is suggested that the government should formulate specific measures to promote the prosperity of the border economy, strengthen international exchanges and cooperation, and further deepen the control of smuggling sources. We will strengthen the ability of the customs anti-smuggling departments to crack down on smuggling and give full play to their duties and duties. Only in this way can the anti-smuggling work in Chongzuo border area be strengthened and the sustainable and healthy development of Chongzuo border area be promoted.
