【摘要】："互聯(lián)網(wǎng)+"的時(shí)代,個(gè)人信息使用的范圍越來越廣泛,受到侵犯的情況也更加多發(fā),危害后果也越來越嚴(yán)重,公民對(duì)于利用刑法保護(hù)公民個(gè)人信息的訴求越來越強(qiáng)烈。然而,中國(guó)刑法對(duì)個(gè)人信息的立法卻相對(duì)滯后。文章論述了個(gè)人信息的一般理論,考察了幾個(gè)主要發(fā)達(dá)國(guó)家關(guān)于個(gè)人信息刑法保護(hù)的狀況,并對(duì)中國(guó)個(gè)人信息刑法保護(hù)的立法現(xiàn)狀進(jìn)行分析,從完善個(gè)人刑法保護(hù)立法的必要性出發(fā),提出了出臺(tái)《中華人民共和國(guó)個(gè)人信息保護(hù)法》的構(gòu)想,完善刑法保護(hù)的前置法律,構(gòu)筑個(gè)人信息在國(guó)家、行業(yè)和個(gè)人三個(gè)層面的刑法保護(hù)體系。
[Abstract]:In the era of "Internet", the scope of personal information is more and more extensive, the situation of violation is more and more frequent, the harm consequence is more and more serious, the citizen's appeal for using criminal law to protect citizen's personal information is more and more intense. However, China's criminal law on personal information legislation is relatively lagging behind. This paper discusses the general theory of personal information, investigates the status of criminal law protection of personal information in several major developed countries, and analyzes the current legislative situation of criminal law protection of personal information in China. In view of the necessity of perfecting the legislation on the protection of personal criminal law, this paper puts forward the idea of issuing the personal Information Protection Law of the people's Republic of China, perfecting the front law of the protection of criminal law, and constructing personal information in the country. The criminal law protection system at the three levels of industry and individual.
