生產(chǎn)、銷售有毒、有害食品罪的認(rèn)定
[Abstract]:In recent years, food safety incidents occur frequently in China. From the Sudan Red incident, which is well known to the Chinese, to the lean meatloin incident, the bad tainted milk powder incident, and the gutter oil incident, which is closely related to everyone's life, and so on. The safety problems of these foods consumed by a wide range of people have forced people to tighten their nerves because the existence of such problems seriously threatens the health and even lives of people and has an extremely bad effect. In view of this, the Criminal Law Amendment (VIII), which began to be implemented in 2011 at a critical time when food safety crimes were prevalent, was adopted and implemented in the context of food safety with the aim of imposing severe penalties for food safety crimes, In this amendment, the minimum legal penalty for this crime has been amended from the original criminal detention or fixed-term imprisonment of not more than five years to not more than five years of fixed-term imprisonment. The aggravation of criminal penalty is a powerful medicine to put psychological pressure into effect. The amended provisions make it possible to punish food safety crimes. My thesis is based on the social pursuit of quality of life, the policy of food safety issues for the background, the study of food safety crime in the core of the charge-production, sale of toxic, harmful food crimes. This article mainly uses the case study method and the analogy analysis method, on the basis of the literature research, after selecting the case, analyzes the specific object, finds out the individual problems existing in this particular object and the commonness with other related cases. Through other people's analysis and demonstration to the dispute case and its cognizance and operation in the judicial practice, this paper shows my opinion on the dispute case. Use inductive deduction, abstract generalization, analysis synthesis and other thinking methods. Through the analysis of several cases, it makes the identification of this crime more clear understanding, and finally can be more freely used in the judicial practice. This paper focuses on the identification of the crime of production, sale of poisonous and harmful food in judicial practice, through the relevant cases, analyzes its related concepts to determine the crime and non-crime. By analyzing the difference between this crime and other related charges, we can choose and apply correctly in judicial practice. In addition, the article also through specific cases to study the most controversial issues about the crime, that is, the form of crime. Finally, the article studies the crime of atypical production, sale of poisonous and harmful food which does not appear in the typical form of crime. Through the above four aspects of analysis, a more thorough understanding of the content of the crime and its application, but also called on the community to pay more attention to food safety.
