【摘要】：隨著社會(huì)的飛速發(fā)展,為保障被保險(xiǎn)人接受醫(yī)療服務(wù)時(shí)的醫(yī)療衛(wèi)生質(zhì)量,滿足廣大群眾患病時(shí)接受醫(yī)療服務(wù)的需求社會(huì)醫(yī)療保險(xiǎn)應(yīng)運(yùn)而生。社會(huì)醫(yī)療保險(xiǎn)是國(guó)家通過(guò)立法規(guī)定,參保人在患病的情況下,可從社會(huì)保險(xiǎn)機(jī)構(gòu)得到相應(yīng)比例的治療費(fèi)用的社會(huì)保險(xiǎn)制度。然而由于社會(huì)醫(yī)療保險(xiǎn)欺詐這一行為的大量出現(xiàn),使得社會(huì)醫(yī)療保險(xiǎn)沒(méi)有發(fā)揮其應(yīng)有的作用。 反社會(huì)醫(yī)療保險(xiǎn)欺詐是維護(hù)社會(huì)醫(yī)療保險(xiǎn)基金健康運(yùn)行的重要途徑,保障參保人社會(huì)保障權(quán)實(shí)現(xiàn)。然而我國(guó)的反社會(huì)醫(yī)療保險(xiǎn)欺詐卻在立法、執(zhí)法和司法上存在不足和缺陷,嚴(yán)重危及社會(huì)醫(yī)療保險(xiǎn)基金的健康運(yùn)行,從而導(dǎo)致我國(guó)的社會(huì)醫(yī)療保險(xiǎn)基金大量流失。因此,提出行之有效的反社會(huì)醫(yī)療保險(xiǎn)欺詐法律對(duì)策是維護(hù)社會(huì)醫(yī)療保險(xiǎn)基金健康運(yùn)行,實(shí)現(xiàn)參保人社會(huì)保障權(quán)的重要手段。 本文通過(guò)由淺入深的方式使用研究歷史法、比較法、社會(huì)學(xué)方法等方法,先對(duì)社會(huì)醫(yī)療保險(xiǎn)欺詐與反欺詐進(jìn)行概述,列舉社會(huì)醫(yī)療保險(xiǎn)欺詐的基本情形。然后對(duì)我國(guó)反社會(huì)醫(yī)療保險(xiǎn)法律制度的現(xiàn)狀進(jìn)行概括總結(jié),之后以英國(guó)、美國(guó)、德國(guó)為代表,剖析社會(huì)保障制度較為完善的國(guó)家,其在反醫(yī)療保險(xiǎn)欺詐方面的立法成就及對(duì)我國(guó)的啟示。最后,根據(jù)我國(guó)的現(xiàn)狀、特殊國(guó)情及搜集的資料提出我國(guó)反社會(huì)醫(yī)療保險(xiǎn)欺詐的基本法律對(duì)策。
[Abstract]:With the rapid development of society, social medical insurance emerges as the times require in order to ensure the medical and health quality of the insured when receiving medical services, and to meet the needs of the broad masses of people to receive medical services when they are ill. The social medical insurance is the social insurance system which the country passes the legislation stipulation, the insured can get the corresponding proportion of the treatment expense from the social insurance institution in the case of illness. However, due to the appearance of social medical insurance fraud, social medical insurance does not play its due role. Anti-social medical insurance fraud is an important way to maintain the healthy operation of social medical insurance fund and ensure the realization of the right of social security. However, China's anti-social medical insurance fraud in legislation, law enforcement and judicial deficiencies and shortcomings, seriously endangering the healthy operation of social medical insurance funds, resulting in a large number of social medical insurance funds in China. Therefore, it is an important means to maintain the healthy operation of social medical insurance fund and realize the right of social security to put forward effective legal countermeasures against social medical insurance fraud. By using the methods of history, comparison, sociology and so on, this paper summarizes social medical insurance fraud and anti-fraud, and lists the basic situation of social medical insurance fraud. Then it summarizes the current situation of our country's anti-social medical insurance legal system, and then takes the United Kingdom, the United States and Germany as the representatives to analyze the countries with relatively perfect social security system. Its legislative achievement in anti-medical insurance fraud and its enlightenment to our country. Finally, according to the present situation of our country, the special situation and the data collected, the author puts forward the basic legal countermeasures of the anti-social medical insurance fraud in our country.
