【摘要】：鑒于中國刑法"立法定性又定量"以及將預備和未遂概括規(guī)定于總則中的特點,應當將實害犯界定為以實際的法益侵害結果的發(fā)生作為犯罪成立條件的犯罪類型,而有別于存在未遂的結果犯。綜觀中國式刑法立法模式,可分為八種類型:僅表述行為型、數(shù)額型、數(shù)額行為選擇型、數(shù)額情節(jié)選擇型、情節(jié)型、嚴重后果型、后果情節(jié)選擇型、危險描述型。嚴重后果型犯罪屬于實害犯,如生產、銷售劣藥罪,對違法票據承兌、付款、保證罪,濫用職權罪,沒有犯罪未遂成立的余地;至于其他類型的犯罪,是否值得處罰犯罪未遂,應進行具體、實質性判斷。一般而言,法益不很重要、法定刑也不重的罪名,沒有必要處罰犯罪未遂,如騙取貸款罪、虛假訴訟罪。
[Abstract]:In view of the characteristics of "legislation qualitative and quantitative" in China's Criminal Law and the generalization of preparation and attempt in the general provisions, the crime of actual harm should be defined as the type of crime in which the actual result of legal interest infringement is taken as the condition for the establishment of the crime. And different from the result of attempted crime. It can be divided into eight types: only expressing behavior type, amount behavior choice type, amount plot choosing type, plot type, serious consequence type, consequence plot choosing type, danger describing type. A crime of serious consequences belongs to a crime of actual injury, such as the crime of producing or selling inferior drugs, the crime of accepting, paying, guaranteeing, abusing of power, and the crime of abusing one's power to an illegal instrument; as for other types of crime, whether or not it is worth punishing the attempted crime, Concrete and substantial judgment should be made. Generally speaking, legal interest is not very important, legal punishment is not serious, there is no need to punish attempted crime, such as fraud loan crime, false litigation crime.
