【摘要】：風險社會下監(jiān)督過失對于責任事故犯罪的預防具有積極意義,但為平衡社會發(fā)展與刑法的法益保護機能,監(jiān)督過失也有適當限縮的必要。被允許的危險作為阻卻違法事由具有限縮監(jiān)督過失的功能。被允許的危險與監(jiān)督過失的界限應重點通過考察監(jiān)督者有無違反一定的行為注意規(guī)則、危險行為與被侵害法益間的利益衡量及有無履行必要的注意義務來綜合認定。被允許的危險理論對于我國監(jiān)督過失犯罪的刑事立法和司法均具有現(xiàn)實借鑒意義,從而為研究我國監(jiān)督過失犯罪提供新的思路。
[Abstract]:In the risk society, the supervision fault has positive significance for the prevention of the crime of the accident of responsibility, but in order to balance the social development with the legal interest protection function of the criminal law, it is necessary to limit the supervision fault properly. The permitted danger acts as an impediment to violations of the law with the function of limited oversight negligence. The limits of permissible danger and supervisory negligence should be determined comprehensively by examining whether the supervisor has violated certain rules of attention, the interests between dangerous behavior and infringed legal interests and whether he has fulfilled the necessary duty of care. The permitted hazard theory has practical significance for the criminal legislation and judicial supervision of negligent crime in China, thus providing a new way of thinking for the study of the supervision of negligent crime in our country.
