【摘要】：當(dāng)行為同時(shí)符合毒品累犯與毒品再犯的成立條件時(shí),二者系特別關(guān)系的法條競合。其中,規(guī)定毒品累犯的法條為特別法條,規(guī)定毒品再犯的法條為普通法條。行為人犯前罪時(shí)已滿18周歲,行為同時(shí)構(gòu)成毒品累犯與毒品再犯的,應(yīng)當(dāng)認(rèn)定為毒品累犯,排除毒品再犯的適用;行為不構(gòu)成毒品累犯但符合毒品再犯成立條件的,應(yīng)認(rèn)定為毒品再犯,排除毒品累犯的適用。行為人犯罪時(shí)不滿18周歲,行為在形式上同時(shí)符合毒品累犯與毒品再犯成立條件的,既不得認(rèn)定為毒品累犯,也不能認(rèn)定為毒品再犯;行為在形式上只符合毒品再犯成立條件而不符合毒品累犯成立條件的,同樣不得認(rèn)定為毒品再犯,不能從重處罰。我國刑法關(guān)于累犯與毒品再犯的規(guī)定,僅適用于犯前罪時(shí)已滿18周歲的人,對于犯罪時(shí)不滿18周歲的人,二者的適用效力均被"凍結(jié)封存"。
[Abstract]:When the behavior conforms to the conditions of drug recidivism and drug recidivism at the same time, the two parties are particularly related to the law of the law. Among them, the law article of the drug recidivist is a special law, which stipulates that the law article of the drug recidivism is an ordinary law. When the person is guilty of the crime, it is 18 years old, and the act constitutes the drug recidivist and the drug again. Drug recidivism, excluding the application of drug recidivism, which does not constitute a drug recidivist but conforms to the conditions for the establishment of drug recidivism, should be recognized as a drug recidivism and exclude the application of drug recidivism. When a perpetrator is guilty of a crime of less than 18 years of age, the act conforms to the conditions of drug recidivism and drug recidivism at the same time, and may not be regarded as a drug recidivist, nor can it be considered as a drug recidivist. It can not be found to be a drug recidivism; the act in form only conforms to the conditions of the drug recidivism and does not conform to the conditions of the drug recidivism, and it should not be identified as a drug recidivism or a heavy punishment. The provisions of the criminal law on recidivism and drug recidivism in our country are only applicable to persons at the age of 18 in the case of pre crime, and are less than 18 years old when the crime is committed. The applicable effectiveness of the two persons is "frozen and sealed".
