【摘要】：貸款詐騙罪作為我國刑法中金融犯罪的重要一部分,是我國乃至世界金融領域頻發(fā)的犯罪,具有破壞范圍廣、破壞性強的特點。因此,本罪的相關諸多疑難問題仍是學術領域與實務部門的爭議焦點。筆者從本罪犯罪構成中的關鍵部分著手,理論結合我國實踐,對爭議較大的幾個問題給出司法認定的路徑,以全面認識貸款詐騙罪。本文共分為五部分。主要介紹了貸款詐騙罪的當前背景,回溯了本罪的立法沿革；論述了本罪侵犯法益的相關學說,最后提出本文筆者的立場——金融安全與財產所有權,也即本罪侵害法益的雙重性。在客觀行為中,以騙取擔保的形式騙取貸款構成貸款詐騙罪,兜底條款中的“其他方法”應該按照罪刑法定原則進行解釋,絕對禁止類推解釋,不作為構成犯罪。對于犯罪形態(tài)來說,本罪即遂與未遂的認定需要結合主觀與客觀情況具體分析。此外,單位應該構成貸款詐騙罪。對于金融機構工作人員參與騙取貸款的行為,應結合相關規(guī)定與共犯理論進行認定。最后,被害人參與騙取貸款的行為應該被引起重視。
[Abstract]:As an important part of the financial crime in our criminal law, the crime of loan fraud is a frequent crime in the financial field of our country and even the world. It has the characteristics of wide range of destruction and strong destructive. Therefore, the related problems of this crime are still the focus of controversy between academic field and practical department. The author starts from the key part of the crime constitution, combines the theory with the practice of our country, gives the path of judicial cognizance to the controversial several problems, in order to fully understand the crime of loan fraud. This paper is divided into five parts. This paper mainly introduces the current background of the crime of loan fraud, traces the legislative evolution of the crime, discusses the relevant theories of the crime of infringing legal interests, and finally puts forward the author's stand-financial security and property ownership. That is, the dual nature of the crime against legal interests. In objective behavior, fraud of loan in the form of swindling guarantee constitutes the crime of loan fraud. The "other methods" in the bottom clause should be interpreted according to the principle of legally prescribed punishment for a crime, and the analogy interpretation is absolutely prohibited, and omission constitutes a crime. For the form of crime, the identification of accomplishing crime and attempted crime needs to be analyzed in combination with subjective and objective conditions. In addition, the unit should constitute the crime of loan fraud. To the financial institution staff participating in the behavior of obtaining the loan, we should combine the relevant regulations with the theory of accomplice. Finally, the victim's participation in the behavior of loan fraud should be paid attention to.
