【摘要】:權(quán)錢交易、官商勾結(jié)歷來是我國黨風(fēng)廉政重點(diǎn)打擊的對象,為了獲取不正當(dāng)利益,很多個(gè)人或集體通過賄賂高官達(dá)到目的的情形不在少數(shù),當(dāng)然與此同時(shí),有關(guān)國家司法機(jī)關(guān)必然會對此種行為進(jìn)行嚴(yán)厲的查處。正因如此,為了規(guī)避法律的制裁,很多更為隱蔽的賄賂方式便營運(yùn)而生,這些賄賂方式最顯著的共同特征就是在表面看來不具有財(cái)產(chǎn)性利益的屬性,實(shí)際上則有著更大的危害,因?yàn)樨?cái)產(chǎn)性利益是“錢權(quán)”的直接交易,但是加入其它種類的賄賂形式則可能對原有的正常社會秩序造成顛覆性的傷害,比如為受托人的家屬提供就業(yè)機(jī)會,損害了正常的競爭上崗的公平秩序;對受托人提供各種保密信息,無疑造成了信息的走漏;給受托人在某些著作上享有署名權(quán)則是對知識產(chǎn)權(quán)的濫用,可以說,非財(cái)產(chǎn)性利益的賄賂形式有著更大的誘惑力和更強(qiáng)的腐蝕性。然而,對于這種危害行為,卻找不到任何明確的法律條文加以規(guī)制,這直接導(dǎo)致該種賄賂形式屢禁不止。為了遏制這種不正之風(fēng),最直接的做法就是將非財(cái)產(chǎn)性利益賄賂納入刑法的規(guī)制范圍,使該行為“入罪”,只有如此,才能打擊有關(guān)人員的囂張氣焰,確保我國社會主義政治、經(jīng)濟(jì)的正常秩序。 基于此,本文對非財(cái)產(chǎn)性賄賂進(jìn)行了較為詳盡的闡述,本論文由四章組成: 第一章是理論分析,主要從理論層面探討了賄賂的概念和特征,以及非財(cái)產(chǎn)性利益賄賂的各種分類,并且介紹了理論界對非財(cái)產(chǎn)性賄賂能否入罪的不同觀點(diǎn); 第二章通過多角度的分析,得出非財(cái)產(chǎn)性利益賄賂法定化的可行性以及必要性,主要從法理基礎(chǔ)、司法實(shí)踐需要、以及國內(nèi)外經(jīng)驗(yàn)等幾方面展開論述; 第三章則是從傳統(tǒng)和現(xiàn)實(shí)等角度深入剖析了在我國將非財(cái)產(chǎn)性利益賄賂納入刑法規(guī)制范圍可能遇到的障礙,主要包括傳統(tǒng)文化認(rèn)同方面、司法實(shí)踐中證據(jù)收集方面,以及量刑等方面的障礙; 最后,結(jié)合我國的實(shí)際情況和現(xiàn)存問題,提出非財(cái)產(chǎn)性利益賄賂入罪的幾點(diǎn)具體建議和對策,不僅包括立法層面的建議,也包括針對司法實(shí)踐中可能遇到的實(shí)際障礙所提出的對策建議。
[Abstract]:Trade in power and money, collusion between government and business has always been the focus of our party's work and clean government. In order to obtain improper benefits, many individuals or groups have been bribing senior officials to achieve their goals, but at the same time, of course, The judicial organs of the countries concerned will certainly carry out strict investigation and punishment of such acts. That is why, in order to circumvent legal sanctions, many more covert forms of bribery have come into operation. The most significant common feature of these forms of bribery is that they do not appear to have the attributes of property interests, but in fact they are even more harmful. Because property interests are direct transactions of "money rights," but adding other forms of bribery may cause subversive harm to the original normal social order, such as providing employment opportunities for the trustees' families. It has damaged the fair order of normal competition and employment; the provision of all kinds of confidential information to the trustees has undoubtedly resulted in the leakage of information; giving the trustees the right of signature in certain works is an abuse of intellectual property rights, and it can be said that, The form of non-pecuniary interest bribery has more allure and stronger corrosiveness. However, there are no clear legal provisions to regulate this kind of harmful behavior, which directly leads to the repeated prohibition of this form of bribery. In order to curb this unhealthy trend, the most direct way is to bring non-property interests and bribery into the scope of the criminal law to "criminalize" the act. Only in this way can we crack down on the arrogance of the personnel concerned and ensure socialist politics in our country. A normal economic order. Based on this, this paper has carried on the more detailed elaboration to the non-property bribery, this paper is composed of four chapters: The first chapter is the theoretical analysis, mainly discusses the concept and characteristics of bribery from the theoretical level, as well as the various categories of non-property interest bribery, and introduces the different views of the theoretical circle on whether non-property bribery can be criminalized; The second chapter through the multi-angle analysis, draws the non-property benefit bribery legalization feasibility and the necessity, mainly from the legal theory foundation, the judicial practice need, as well as the domestic and foreign experience and so on several aspects carries on the elaboration; The third chapter is from the perspective of tradition and reality in-depth analysis of the non-property interests bribery into the scope of criminal law may encounter obstacles, including the traditional cultural identity, judicial practice in the collection of evidence. And the obstacles of sentencing; Finally, combined with the actual situation and existing problems in our country, this paper puts forward several specific suggestions and countermeasures for the criminalization of non-property interests bribery, including not only the legislative proposals, It also includes countermeasures and suggestions for practical obstacles that may be encountered in judicial practice.
