【摘要】：過(guò)失注意義務(wù)的判斷標(biāo)準(zhǔn)歷來(lái)存在主觀說(shuō)與客觀說(shuō)之爭(zhēng)。主觀說(shuō)以行為人的主觀認(rèn)識(shí)為標(biāo)準(zhǔn)認(rèn)定注意義務(wù)的有無(wú),這容易導(dǎo)致在主觀上謹(jǐn)慎,具備較高知識(shí)的人比在主觀上馬虎大意,認(rèn)識(shí)水平低的人更容易入罪,這在一定程度上打擊了先進(jìn)、保護(hù)了落后;客觀說(shuō)有其合理性,但是,它在保護(hù)了先進(jìn)的同時(shí),仍然還是"鼓勵(lì)"了落后。在確定注意義務(wù)的認(rèn)識(shí)標(biāo)準(zhǔn)時(shí),應(yīng)當(dāng)以角色分工理論為標(biāo)準(zhǔn)加以確定,一方面打擊落后,另一方面保護(hù)先進(jìn)。同時(shí),借助角色分工理論,傳統(tǒng)理論中"平均人"、"一般人"這樣的抽象概念可以被客觀、明確地加以厘定。
[Abstract]:The judgment standard of negligent duty of care has always been disputed between subjective and objective. The subjective theory regards the subjective cognition of the actor as the standard to determine whether there is a duty of care or not, which can easily lead to subjective caution. The person with higher knowledge is more likely to be criminalized than the person who is sloppy in subjective sense and who has low level of knowledge. To a certain extent, this has dealt a blow to the advanced and protected backwardness; objectively speaking, it has its rationality, but it still "encourages" backwardness while protecting the advanced. In determining the cognitive standard of duty of care, the theory of division of roles should be taken as the criterion to combat backwardness on the one hand and protect the advanced on the other. At the same time, with the help of the theory of division of roles, the abstract concepts of "average person" and "general person" in traditional theory can be determined objectively and clearly.
