【摘要】：鹽關(guān)系國(guó)計(jì)民生,政府歷來(lái)對(duì)其實(shí)行專(zhuān)營(yíng)專(zhuān)賣(mài),并訴諸于刑。我國(guó)涉鹽行為入罪用刑始于漢代,至唐朝五代十國(guó)時(shí)期,涉鹽犯罪的刑多且更為苛嚴(yán),最高可處以死刑。宋元時(shí)期涉鹽犯罪的刑罰有所輕緩,明清涉鹽犯罪的刑罰制度已相對(duì)成熟完備。新中國(guó)成立后,1979年刑法初始規(guī)制涉鹽的投機(jī)倒把行為,1997年刑法主要規(guī)制非法經(jīng)營(yíng)鹽的行為,并輔之規(guī)制生產(chǎn)、銷(xiāo)售偽劣鹽的行為。隨著我國(guó)鹽業(yè)體制的改革和變化,非法經(jīng)營(yíng)鹽的行為應(yīng)當(dāng)出罪,刑法主要對(duì)涉生產(chǎn)、銷(xiāo)售偽劣鹽的行為進(jìn)行規(guī)制更為科學(xué)合理。
[Abstract]:Salt related to the national economy and the people's livelihood, the government has always carried out monopoly monopoly, and resorted to punishment. China's salt related criminal punishment began in the Han Dynasty, to the Five Dynasties and ten countries of the Tang Dynasty, the salt related crimes were more severe and more strict, the highest could be executed. The penalty of salt related crimes in the song and Yuan Dynasties was gentle and the penalty system of salt related crime was relatively mature in the Ming and Qing Dynasties. After the founding of new China, the initial regulation of the criminal law in 1979 was the initial regulation of salt speculation. In 1997, the criminal law mainly regulated the behavior of illegal operation of salt, supplemented by the regulation of production and selling fake salt. With the reform and change of the salt industry in China, the illegal operation of salt should be offended, and the criminal law mainly deals with the production and sale of fake and inferior salt. It is more scientific and reasonable to regulate the behavior.
