【摘要】：德國(guó)刑法學(xué)中的客觀歸責(zé)論并非完美的理論,在規(guī)范論、本體論和體系論方面存在嚴(yán)重缺陷。在維持現(xiàn)行犯罪論體系的前提下,中國(guó)刑法學(xué)不應(yīng)全面借鑒客觀歸責(zé)論。提倡客觀歸責(zé)論、反對(duì)相當(dāng)因果關(guān)系說(shuō)的觀點(diǎn),不僅無(wú)視客觀歸責(zé)論的不足,而且夸大了相當(dāng)因果關(guān)系說(shuō)的危機(jī),值得深入反思�？陀^歸責(zé)論與相當(dāng)因果關(guān)系說(shuō)并非對(duì)立關(guān)系,修正后的相當(dāng)因果關(guān)系說(shuō)部分采取了客觀歸責(zé)方法論。批判客觀歸責(zé)論本身,并不等于否定客觀歸責(zé)方法論。修正的相當(dāng)因果關(guān)系說(shuō)更加契合我國(guó)刑法理論,它應(yīng)當(dāng)成為我國(guó)刑法因果關(guān)系論的發(fā)展方向。我國(guó)刑法因果關(guān)系論應(yīng)當(dāng)借鑒危險(xiǎn)的現(xiàn)實(shí)化說(shuō)的判斷框架,并引進(jìn)結(jié)果的抽象化說(shuō)和綜合判斷說(shuō)中的部分基準(zhǔn)。
[Abstract]:The objective imputation theory in German criminal law is not perfect theory, and it has serious defects in normative theory, ontology and system theory. Under the premise of maintaining the current criminal theory system, Chinese criminal jurisprudence should not draw lessons from objective imputation theory. The viewpoint of advocating objective imputation and opposing the theory of equivalent causality not only ignores the deficiency of objective imputation, but also exaggerates the crisis of the theory of equivalent causality, which is worthy of further reflection. The theory of objective imputation and the theory of equivalent causality are not opposites, and the revised theory of equivalent causality adopts the methodology of objective imputation. Criticizing objective imputation does not mean denying objective imputation methodology. The revised equivalent causality theory is more in line with the theory of criminal law in China, and it should be the developing direction of the theory of causality in criminal law of our country. The causality theory of criminal law of our country should draw lessons from the judgment frame of the dangerous reality theory, and introduce the abstract theory of the result and some benchmarks of the comprehensive judgment theory.
