【摘要】：目前環(huán)境問題已經(jīng)成為影響人類生存和發(fā)展的全球性問題。很多國(guó)家通過(guò)訂立環(huán)境刑法來(lái)解決日益嚴(yán)重的環(huán)境問題。由于我國(guó)刑法沒有對(duì)環(huán)境犯罪所侵害的客體做明確的規(guī)定,因此學(xué)術(shù)界對(duì)此爭(zhēng)論不休。關(guān)于環(huán)境犯罪的客體學(xué)界有很多學(xué)說(shuō),各學(xué)說(shuō)都有它的合理之處,但卻沒有形成一個(gè)統(tǒng)一的觀點(diǎn)。本文以環(huán)境犯罪客體為視角,對(duì)其中的基本理論問題進(jìn)行研究,并重新明確環(huán)境犯罪所侵犯的客體。文章主要分為四部分,共三萬(wàn)多字。主要內(nèi)容如下:引言。主要介紹論文的研究背景、論文的選題意義。第一部分主要是對(duì)環(huán)境犯罪客體的概述。本章主要是介紹對(duì)環(huán)境犯罪客體的認(rèn)識(shí)和環(huán)境犯罪客體的特征。對(duì)環(huán)境犯罪客體的認(rèn)識(shí)從兩個(gè)方面來(lái)闡述,既對(duì)傳統(tǒng)的環(huán)境犯罪客體的認(rèn)識(shí)和當(dāng)代環(huán)境犯罪所侵犯客體認(rèn)識(shí)。對(duì)環(huán)境犯罪所侵犯的客體有一定的認(rèn)識(shí)才能對(duì)某行為是否構(gòu)成環(huán)境犯罪有準(zhǔn)確的把握。這就為下文的研究做出必要的準(zhǔn)備。第二部分主要是對(duì)國(guó)內(nèi)外環(huán)境犯罪客體各學(xué)說(shuō)的整理與評(píng)析。國(guó)內(nèi)有關(guān)環(huán)境犯罪客體學(xué)說(shuō)有多種,本章對(duì)幾種主要的觀點(diǎn)進(jìn)行介紹以及對(duì)各種觀點(diǎn)加以評(píng)析。其次是對(duì)國(guó)外環(huán)境犯罪客體說(shuō)法的介紹以及本人的評(píng)析,主要以德國(guó)、美國(guó)及日本為例。第三部分主要是關(guān)于我國(guó)環(huán)境犯罪客體的相關(guān)規(guī)定及其不足。主要是在梳理我國(guó)現(xiàn)行相關(guān)法律的基礎(chǔ)上,將我國(guó)與外國(guó)環(huán)境犯罪客體進(jìn)行比較分析,得出我國(guó)現(xiàn)行的環(huán)境刑事立法對(duì)環(huán)境客體保護(hù)的不足,主要是環(huán)境犯罪客體在整個(gè)刑法中的地位較低,以及刑事法律對(duì)環(huán)境保護(hù)范圍過(guò)窄。第四部分是對(duì)環(huán)境犯罪客體的重新界定及調(diào)整現(xiàn)行的法律體系�；谖覈�(guó)在環(huán)境刑事立法方面的不足,提出環(huán)境犯罪客體應(yīng)當(dāng)為環(huán)境法益,并說(shuō)明環(huán)境法益內(nèi)涵與外延,環(huán)境法益為環(huán)境犯罪客體的原因和意義;建議將環(huán)境犯罪獨(dú)立成章并分析獨(dú)立成章的原因和新章節(jié)的體例安排,最后是建議增加幾個(gè)新的環(huán)境犯罪的具體罪名。
[Abstract]:At present, environmental problems have become a global problem affecting the survival and development of human beings.Many countries solve the increasingly serious environmental problems by establishing environmental criminal law.Because the criminal law of our country does not make the explicit stipulation to the object which the environment crime infringes, therefore the academic circles debate about this.There are many theories about the object of environmental crime, each theory has its reasonable place, but has not formed a unified viewpoint.From the perspective of the object of environmental crime, this paper studies the basic theoretical issues and redefines the object infringed by environmental crime.The article is mainly divided into four parts, a total of more than 30,000 words.The main contents are as follows: introduction.This paper mainly introduces the research background and the significance of the thesis.The first part is an overview of the object of environmental crime.This chapter mainly introduces the understanding of the object of environmental crime and the characteristics of the object of environmental crime.The understanding of the object of environmental crime is expounded from two aspects, that is, the understanding of the traditional object of environmental crime and the understanding of the object violated by the contemporary environmental crime.Only by a certain understanding of the object infringed by environmental crime can we have an accurate understanding of whether an act constitutes an environmental crime.This makes the necessary preparation for the following research.The second part is mainly to the domestic and foreign environmental crime object theory arrangement and the appraisal.There are many kinds of theories about the object of environmental crime in China.Secondly, it introduces the object of environmental crime and comments on it, mainly taking Germany, America and Japan as examples.The third part is about the environmental crime object of our country and its deficiency.On the basis of combing the current relevant laws of our country, this paper compares the object of environmental crime between China and foreign countries, and draws the conclusion that the current environmental criminal legislation of our country is insufficient to protect the environmental object.The main reason is that the object of environmental crime has a low position in the whole criminal law, and the scope of criminal law is too narrow to protect the environment.The fourth part redefines the object of environmental crime and adjusts the current legal system.Based on the deficiency of our country's environmental criminal legislation, this paper puts forward that the object of environmental crime should be the benefit of environmental law, and explains the connotation and extension of environmental law, and the reason and significance of which environmental law is the object of environmental crime.It is suggested that the environmental crime should be made into an independent chapter, and the reasons for the independent chapter and the arrangement of the new chapter should be analyzed. Finally, it is suggested that several new specific charges of environmental crime should be added.
